Sherimaci, Chairman P,,')A- D 01" TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 24, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application of DAVID M. BRADT (044 -85) of Madaket Road, P.O. Box 1797, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under SECTION 6F 8 (codified as Section 1.39 -2214, Employer Dormitories) of the Zoning By-Law. The property is located on APPLETON ROAD, Plan No. 66, Lot No. 19.1 in the RESIDENTIAL - COMMERCIAL -2 District. If relief is granted, Applicant will be able to put an existing single- family residence (relocated from another site) into use as an employer dormitory without an approximately one -year delay under Sec- tion 7C (codified as Section 139 -27, Rate of Develop ment or Building Cap). 2. The Application was heard at our Public ;fearing on May 24, 1985. Applicant presented a photoprint of the house moved to the locus, also copy of the Building Inspector's stop -order letter of April 29, 1985. As noted in that letter, a structure moved to a new site does not carry with it a use or occup�:ncy permit. Foundation work or other construction at the new site requires a building permit. If to be principal or s�_condary dwelling (in- cluding garage apartment), it is deemed "nee:" under Section 139 -27 jnd sub- ject to the cap. 3. According to the opinion letter of Town Counsel dated November 19, 198 +, employer dormitories are commercial and not subject to the building cap. Applicant's proposed dor- mitory use of the premises ha:, the favorably: recommendation of the Planni.nw, Board and two letters of record. No oppo- sition was heard. 4.
