DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 24,
1985 at 1:30 p.m in the Town and County Building, Nantucket, rendered the
following decision in the Application of TWENTY FOUR BROAD STREET /DBA LE
LANGUEDOC (042 -85) of 24 Broad Street, Nantucket 02554.
1. Applicant seeks relief by SPECIAL PERMIT to allow interior struc-
tural modification of an existing building and altered or intensified use.
Relief is asked from the parking requirements of Zoning By -Law SECTION 6B
(codified as Section 139 -18) and pursuant to SECTION 7I (codified as Section
139 -33) concerning alteration or expansion of pre- existing non - conforming
uses or structures. The property is located at 34 CENTRE STREET, Par-
cel 120, Map 42.3.1 in the RESIDENTIAL - COMMERCIAL Zoning District.
2. Through counsel, Applicant claims a pre- existing, non - conforming
use of the building with 3 apartments distributed between the first and
second floors. The basement is and will be restricted to storage use. Pro-
posed interior modification shown on floor.plans of record, would transform
the five rooms on each of the first and second floors from use as three
apartments into the following:
First Floor: one single bedroom apartment plus three guest
bedrooms;
Second Floor: one single bedroom apartment plus two guest
bedrooms.
3. As evidence that two, not three, apartments each limited to one
bedroom, along with five new guest bedrooms would not increase actual park-
ing demands, the May 22, 1985 letter of Nantucket Accomodations was cited.
Short stays in guest rooms, without children and in the face of obstacles
to bringing personal autos, are indicated by a 1984 survey as minimizing
parking requirements of guests. No contraverting evidence was offered nor
survey results for apartment use.

4. Under the off - street parking requirements By -Law section, as
amended at the April 1985 Annual Town Meeting, Applicant would have to pro-
vide 3 parking spaces plus 1 for each 3 guest rental units over 2, plus 1
for each apartment, less three spaces "grandfathered" for the three pre-
existing apartments. (Section 139 -18A requires enlargement of a building to
bar grandfathering.) By this reckoning, Applicant should provide 3 spaces
but cannot physically do so without modifying the historic structure.
5. Criteria for grant of a Special Permit are set and in Section 139-
18 G, as amended by Article 16, April 1985 ATM. Critical is our determina-
tion that granting relief would be in harmony with the spirit and purpose
of the By -Law chapter.
6. Other favorable letters were received from guest house operators
(3), other abuttors (2) plus the Nantucket Chamber of Commerce and Infor-
mation Bureau. Besides commending the quality of Applicant's related oper-
ations, remarks were to the effect of minimal parking and traffic impact.
Opposed on parking grounds were letters from 4 residents of India Street,
next south of the locus. At 17 India Street, the Nantucket Hospital Thrift
Shop (joined by its Hospital "parent ") cites a previous denial of relief to
Applicant's predecessor. Since then, however, the By -Law has been amended
to loosen (but not to give up) the parking space requirements. The Planning
Board's recommendation was unfavorable on grounds of too dense a use.
7. We remain strongly mindful of the public's
parking in Town. Nevertheless, Applicant has met the
right to special permit relief and in particular has

waiving the By -Law requirement for 3 off - street parking spaces conditioned
upon Applicant's use of the building as set forth above, specifically with
no more than 2 single - bedroom apartments.
