Decision:
At a meeting of the Board of Appeals held at 1:30 P.,':.,
Friday, May 24, 1985 in the Town and County Building, Nantucket,
MA in the matter of the Application of George. Sykes III and
Jane Buckley Sykes (040 -85), the Board finds:
1. `Phis is an application for a Variance pursuant to section
7H (codified as 139 -32) for relief from section 5, Intensity Rcou-
lations (codified as Section 139 -16) of the Zoning By -law with
respect to the premises shown as Lot 2, Plan Book 14, Page 11,
known and numbered as 49 Pleasant Street. The Applicants seek a
Variance to cure an alleged technical defect in marketability which
arose when the division of the original lot pursuant to the su'.
division control law created two lots, each non- conforminc unC.t-
the Zoning By -law.
2. Based upon a review of the Application, supporting docu-
ments, plans and testimony the Board finds that the property situ-
ated on Pleasant Street, consists of two lots;on Lot 1 is a single
family dwelling,on Lot 2 is a retail store. Both of said buildings
were in existance at the effective date of the Subdivision. (_:ontrcl
in Nantucket. Lot 2 is nonconforming as to area, around cover
ratio, front, rear and side line set back requirements. The Appli-
cants do not request any relief to alter or change the existing
structures or the use thereof.
3. The size of the existing building and land area precluded
division into two lots conforming to zoning. The location of the
existing structures, and the shape and topography of the premises
as a whole dictated the location of the division line as appearina
on the plan.
The Board finds that the shape of the lot, the tcpograpr:y
thereof, the siting of the buildings thereon, and the technical
zoning violations which affect the marketability of title do not
generally affect the Residential zoning district in which the property
is located. The Board further finds that a literal enforcement of
the Zoning By -law would involve substantial hardship to the Applicants
by rendering the premises unmarketable. The desired relief may be
granted without substantial -_ietriment to the public rood and with-

5. For the reasons and upon the conditions set forth
herein, the Board, by Unanimous Vote, hereby GRANTS to the
Applicants the requested relief from Section 5 (Intensity
Pequlations) of the Zoninq By-law by Variance as requested.
