Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 24, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application of THOMAS RISCH (038 -85) of 101 Kettle Creek, Weston, MA. 1. Applicant seeks a SPECIAL PERMIT under By -Law SECTION 71.1 (codi- fied as Section 139 -33A) to complete renovation and resume a pre - existing use of the apartment in his single- family dwelling. The property is located at 15 INDIA STREET, Assessor's Map 42.3.1, Parcel 160 in the RESIDENTIAL - OLD- HISTORIC District. He is thus concerned with alteration of a pre- existing use, non - conforming in that district. 2. On the basis of representations and testimony we find that the apartment use pre- existed zoning, long continuing under Applicant's pre- decessor and not abandoned. Specific to the question of a possible abandon- ment, answer was given that use of the apartment was seasonal. No contrary evidence was received. The Nov. 20, 1984 letter of predecessor Hayden con- firms our finding. 3. The Planning Board's recommendation was unfavorable but only questioning pre -1972 existence of the apartment. An immediate abuttor's letter was favorable, none unfavorable. Rquired parking is provided. 4. We.find that the proposed alteration of the pre- existing non- conforming use will not be substantially more detrimental to the neighbor- hood than the existing non - conforming use. The alteration is simply interior design improvements with appropriate access. 5. Accordingly, the Board, by UNANIMOUS vote, GRANTED the SPECIAL PERMIT under SECTION 71.1 to alter a pre- existing non - conforming use.
