DECISION:
The BOARD OF APPEALS at a Public Hearing on FRIDAY, MAY 31 1985
at 1:30 p.m. in the Town and County Building, Nantucket, rendered the
following decision in the Application of JAMES G. TYLER (037 -85) whose
address is Sankaty Avenue, Siasconset, MA.
1. This is an Application for a SPECIAL PERMIT under Zoning By -Law
SECTION 5.3 ( side lot setback reduction by Special Permit - codified as
Section 139 -16C). If granted, Applicant would be allowed to complete con-
struction of an addition to his single- family dwelling despite encroachment
on the normally- required ten -foot side lot line setback. The premises are
located on SANKATY AVENUE, SIASCONSET, Plan 12 -F, bounded by Isobel's Way
on the south and west sides and the Sankaty Head Golf Course on the north
side, the side adjacent the addition. The zoning district is RESIDENTIAL -2.
2. Based upon the Applica tion and a plan, representations and test-
imony submitted at the hearing, Applicant commenced construction of an add-
ition to his principal dwelling to accomodate a growing family. The en-
croachment was discovered from a mortgage plot plan after a survey. Con-
struction was done in 1982 pursuant to a 1981 building permit. Existing
roof planes constrained location of the addition proximate the north lot
line, about 5 feet or more removed.
3. No opposition to Applicant was voiced. Nothing in our record in-
dicated construction was actually extended into the setback in disregard
or contravention of the by -Law.
4. The Planning Board made no recommendation due to sparsity of in-
formation before them.
5. We find that the completion of the addition into the present 10-
foot setback (but not into the older 5 -foot setback) is in harmony with the
general purpose and intent of the By -Law. This request for relief meets the
criteria for issuing a Special Permit per Section 7F (codified as Section
139 -33).
6. Accordingly, the Board by UNANIMOUS vote, GRANTS to Applicant a
SPECIAL PERMIT reducing the 10 -foot north side lot line setback to 5 feet.

FRIDAY, MAY 39 1985 at 1:30 p.m. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of JAMES
G. TYLER (037 -85) seeking a SPECIAL PERMIT under SECTION 139 -16
(C) (new codification) of the Zoning By -Law. If granted, the
Applicant would be permitted to decrease the set back requirement
from 10 feet to 5 feet to allow an addition to be constructed on
an existing dwelling. The premises are located at SANKATY AVENUE,
SIASCONSET, PLAN 12 -F and is zoned RESIDENTIAL -2.
