OF APPEALS which has this day been filed with the Town

DECISION:
The BOARD OF APPEALS, at a Public Hearing on FRIDAY, MAY 3, 1985
at 1:30 p.m. in the Town and County Building, Nantucket, rendered the
following decision in the Application of BRACE YOUNG (034 -85) whose address
is 8 King Street, Siasconset, MA.
1. This is an Application for a SPECIAL PERMIT under Zoning By -Law
SECTION 71 (reconstruction and extension of a pre - existing, non-conforming
use- codified as Section 139 -33). If granted, Applicant would be allowed to
replace an existing garage with an enlarged garage - storage structure on the
same footprint plus an additional 80 SF. The property is located at 8 KING
STREET, SIASCONSET and is zoned RESIDENTIAL -1.
2. Based upon the Application, letters, viewing and drawings and
representations submitted on behalf of Applicant, we find that a corner of
the pre- existing non - conforming garage is approximately two feet from the
side lot line. Abuttor's guest house is perhaps 7 feet on the opposite side
from this nearest`°`point. The proposed extension is away from the lot line
and the abuttor's structure veers away in the opposite direction.
3. The expanded garage will provide additional ground level and loft
storage, proper ancillary uses tending to improve sightliness of the pre-
mises.
4. The Planning Board's recommendation was favorable to the expansion
but conditioned on re- siting the new structure outside the side line set-
back, important for safety reasons noting proximity to the abuttor's house.
Based on the viewing, we believe the proposed expansion will not be detri-
mental to safety (nor in other respects to be substantially more detrimental
to the neighborhood than the existing non - conforming use).
5. No opposition was heard. The sole communication from a neighbor
was a letter favorable to Applicant.
6. We find that grant of the Special Permit sought would be in
harmony with the general purpose and intent of the By -Law.
7. Accordingly, the Board, by UNANIMOUS vote, GRANTED to Applicant
the SPECIAL PERMIT to recontruct and extend the garage as requested.

FRIDAY, MAY 31 1985 at 1:30 p.m. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of
BRACE YOUNG (034 -85) seeking a SPECIAL PERMIT under SECTION 71
(alteration of a pre- existing non - conforming use) of the Zoning
By -Law. If granted, the Applicant would be allowed to replace an
existing garage with a new garage which will be larger than the
original building by 80 square feet and it will have a partial
second -floor to be used for storage. The property is located at
