Sherman, Chairman BOARD OF APPF'ALS TO1ti'N OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS at a Public Hearing held on FRIDAY, MAY 3, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application of PETER V. REID (032 -85). 1. This is an Application for a VARIANCE from Zoning By -Law SECTION 4A 1.b(2) (secondary dwelling- codified as 139- 7A(2)(b)) made applicable in the RESIDENTIAL -2 zoning district by Section 4B 1.a (codified as Section 139 -8A (1)) and also for a VARIANCE from SECTION 5.1 (ground cover - codified as Section 139 -16A). The premises, located at 20 BAXTER ROAD, SIASCONSET, Lot 36 and 37, Assessor's Map 49.2.3, are zoned RESIDENTIAL -2. 2. The Applicant's representative noted that the principal dwelling was located before zoning on Lot 37j of about 17,500 SF. The garage behind it, non- conforming with respect to rear lot line setback, also pre -dated zoning. Thier combined ground cover is only 23 SF short of the total al- lowed for the site, severely limiting the footprint of a secondary dwelling, absent relief by variance. Additionally, a secondary dwelling of the 732 SF footprint proposed by Applicant could not be located on the site in re- lation to the principal dwelling and required lot line setbacks without variance relief. Applicant has elected a siting closer than the required 12 feet spacing in front of or behind the principal dwelling. 3. We are reminded that the severe constraints upon Applicant date from the 1984 re- zoning from R -1 to R -2. A hardship is faced to forego a secondary dwelling or relocate the principal dwelling. [�e are not per- suaded, however, that this is a hardship of the type required for grant of a variance under. By -1,aw Section 7H (codified as Section 139 -32). Alter- native of a garage apartment was noted. 4. The Planning Board has recommended our favorable action after reviewing Applicant's proposal pursuant to his submission under Sec- tion 4A l.b(7) (codified as 139 -7A (2) (g)). Reasons are not ziver.. 5. Counsel representing an abuttor noted close proximity of abuttor's existing structure to the proposed siting and objected to grant of a var- iance. From a viewing, it appeared that a secondary dwelling, sited as proposed, would also be discordant with the existing openness of grounds surrounding large main houses in the neighborhood. 6. Accordingly, we are unable to find that the requested relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By -Law. 7. (2.) as applied through 4B 1. a. and Section 5 - (ground cover ratio) u` ng I jCL M tQ Reason for asking relief: The design and placement of the existing house and lot, both of which pre -date zoning, prohibit strict compliance in any way with the Building Department's current interpretation of Section 4A 1.(2.). The recent change of zoning from R -1 to R -2 in April 1984 would limit a second dwelling to 232 sq.ft. to comply with the new ground cover restrictions.
