Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law Section 139- 33.A(1)(b) that the proposed extension, alteration, and change to the conforming structure on the pre- existing nonconforming lot by renovation and construction of conforming additions to the structure will not increase the nonconforming nature of the lot, and will not create any new nonconformities. 2. The Applicant is proposing to alter the existing structure by building additions to this approximately 915 square foot dwelling known as "Clew ", Unit 5 of seven units in Crow's Nest Cottages Condominium. The alterations consist of bump -out additions on the north, east, and west elevations of the dwelling. On the south elevation, the gable is bumping out with the main ridge going up approximately sixteen (16) inches and the secondary ridge going up approximately ten (10) inches. The resulting ridge height will be a compliant 15 feet, 8 inches. 3. The total additional ground cover for this unit will be approximately 379 square feet, bringing the dwelling's entire ground cover to approximately 1,294 square feet. The existing total ground cover of the seven (7) cottages is approximately 6,806 square feet where 27,547 square feet of ground cover is allowed. Therefore, the proposed addition, sited within the buildable portion of the Property, will increase the ground cover ratio of the entire lot from approximately 7.4% to approximately 7.8% in a zoning district where a maximum 30% ground cover ratio is allowed. The total lot area is 91,824 square feet in a district that requires a minimum lot area of 5,000 square feet. 4. The Locus, as shown on plan entitled "As -Built Plan of Crow's Nest Cottages ", dated December 10, 2015, prepared by Michael Connolly & Associates, Inc., a reduced copy of which is attached hereto and marked as "Exhibit A ", is pre- existing non - conforming with respect to setbacks, with Unit 7 (known as "Reef Point ") being sited within the required five (5) foot side yard setback and Unit 1 (known as "Grover ") sited within the required ten (10) foot front yard setback. The Locus is also pre- existing nonconforming with respect to the siting of seven structures on a single lot where a maximum of two are allowed pursuant to 139- 7.13(1). 2 5. The subject structure, as shown on "Existing Site Plan For Zoning Administrator Decision in Nantucket, Ma.," dated December 10, 2015, prepared by Michael Connolly & Associates, Inc., a reduced copy of which is attached hereto and marked as "Exhibit B ", is conforming as to the dimensional requirements of By -law Section 139 -16.A. The proposed alterations benefit from Nantucket Historic District Commission approval by virtue of Certificate of Appropriateness No. 64805, as the same may be amended from time to time. The subject unit was granted a prior Special Permit in 1999 for a seventy (70) square foot addition in Zoning Board of Appeals File No. 089 -99. Similar relief has been granted to other condominium units on the premises in the past. 6. The proposed extension, alteration, and change to the conforming structure on the pre- existing, nonconforming Locus by renovation and construction of an addition will not create any new nonconformities. The subject structure and Locus will remain conforming as to ground cover, height, and parking. Therefore, the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the Locus. 7. Based upon the plan entitled, "Proposed Site Plan For Zoning Administrator Decision in Nantucket, Ma.," dated December 10, 2015, prepared by Michael Connolly & Associates, Inc., a reduced copy of which is attached hereto and marked as "Exhibit C ", the Zoning Administrator finds that the proposed work will take place within the buildable portion of the property, will not create any new nonconformities, and will not increase the nonconforming nature of the Locus, and hereby issues the permit as requested.
