Sherman, Acting Chairman BOARD OF APPEALS I. • BOARD OF APPEALS TOWN OF NANTUCKET y NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing on WEDNESDAY, MARCH 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application of PETER F. DOOLEY (015 -85) whose address is Madaket Road, Nantucket. 1. This is an Application for a SPECIAL PERMIT under SECTION 71 of the Zoning By -Law to expand or alter a pre- existing non - conforming restau- rant use by inclusion of full liquor service, beer and wine now being licensed by action of the Board of Selectmen on or about March 12, 1984. That license followed grant by this Board of a Special Permit under Sec- tion 71 allowing expansion of the pre- existing restaurant use to include beer and wine service, that decision filed April 6, 1984 (016 -84). The premises are located at the westerly end of the arterial MADAKET ROAD, Assessor's Map 60, Parcel 104, Land Court Plan 3092 -7, Lot 199 and zoned RESIDENTIAL -2, and are owned by WEP, Inc. (of which Applicant is said to be president and principal stockholder). 2. Applicant has not, and does not now seek a Special Permit to operate a tavern or a bar. The existing and proposed alcoholic beverage service is strictly ancillary to restaurant meal service at tables with patrons seated. No change in restaurant character or type of menu is planned nor is expansion in capacity proposed. 3. If and when Applicant applies to the Board of Selectmen for a full liquor pouring license, his request can be refused or can be granted with restrictions as to hours and locations on the premises where pouring is permitted. We are simply to decide whether the proposed expansion is legally permissible under the By -Law and, if so, what other conditions should be imposed to assure that the use is in harmony with the general purpose and intent of the By -Law. 4. In Applicant's oral presentation through counsel, uncertainty was expressed whether a Section 71 Special Permit was required at all for expansion from beer and wine to full liquor service. At our request, Appli- cant's assurance was obtained that he accepted his need of such permit in . -2- (015 -85) invoking our jurisdiction reserving, of course, his right to appeal other- wise from any action taken here. In any event, a valid pre- existing non- conforming use has been found in a predecessor snack bar predating the By -Law, from which the present Westender Restaurant evolved. Superior Court Civil Action No. 1984 is cited. 5. We have carefully reviewed the many letters received from the parties in interest up to the time of the Hearing, all primarily in oppo- sition. From these, the Application papers and oral presentations, the following are the main grounds of opposition: (1) road hazards from patrons driving under the influence after drinking to excess; (2) excessive noise reaching immediate abuttors, eg., noise from Applicant's patio or deck at "11:30 p.m. precluding sleep;" (3) high density of traffic in front of his establishment; (4) potential for "creeeping" expansion to include "ent.er- tainment" with attendant increase of noise and other incidents. 6. Response for Applicant included statements of several (four) supporters that his operations to date were useful to the community, quiet, tasteful and in a spirit of congeniality in keeping with the neighborhood setting. They foresaw no detrimental change. Service is now licensed only until 11:00 p.m., and no extension of licensing to 1:00 a.m. will be sought. No license or permit to offer entertainment will be sought, and so conditioning grant of a Special Permit here will be accepted by Appli- cant. 7. The Planning Board's recommendation was favorable. 8. Considering the limited degree of expansion 4n Applicant's non- conforming use from beer and wine to full liquor service, the resulting uncertainty whether outright refusal of a Special Permit would be sus- tained on appeal and the independent determination by the Board of Select- men required in obtaining a full liquor pouring license, we believe the ,` (015 -84) -3- question whether or not the expansion will be substantially more detri- mental to the neighborhood cannot be resolved simply by counting those for and against. Given our power to impose conditions upon Applicant's operations beyond those available to the Board of Selectmen, we find for Applicant on this issue. The conditions are: (1) Applicant is restricted to use of the premises as a restaurant (not a tavern or a bar) in offering full liquor service, and (2) no entertainment shall be offered. With these, the Board finds that the proposed expansion of use of the premises will be in harmony with the general purpose and intent of the By -Law. 9. The Board, by UNANIMOUS vote, hereby GRANTS to Applicant a SPECIAL PERMIT pursuant to SECTION 71 to expand the pre- existing non -con- forming restaurant use of the premises from wine and beer to full liquor service, subject to the foregoing conditions.
