Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. BOARD OF APPEALS William R. Sherman, Acting Chairman TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held at 1:30 p.m. on FRIDAY, FEBRUARY 15, 1985, in the Town and County Building, .•. Nantucket, the Application of JEAN CHARLES BERRUET (013 -85) whose address is Polpis Road, Nantucket, was heard: 1. This is an Application for a SPECIAL PERMIT under SECTION 71 of the Zoning By -Law for extension of a pre- existing non-conform- ing use. If granted, Applicant would be permitted to add a wine storage shed to the locus of THE CHANTICLEER INN, OFF NEW STREET, SIASCONSET, Plan #73.13 -038 and is zoned RESIDENTIAL -1. 2. Based upon a review of the Application, site plan, copy of HDC Certificate of Appropriateness, granted January 22, 1985, repre- sentations of counsel and correspondence of record, the Board finds that the proposed extension of the non - conforming use would be in harmony with the general purposes and intent of the Zoning By -Law. The shed , 16' by 18' (288 sf) and smaller than other existing accessory buildings, would be used solely for storage of wine to be consumed on the premises. 3. The shed would be located proximate the easternmost side- line, extending from an existing building northerly parallel to that side -line. Applicant has not sought by this extension to increase any non - conformity with respect to side -line set back, ie., the wine storage shed will not be closer to the side -line. A five foot set back is required in the R -1 District. 4. The Planning Board recommended favorable action. No oppo- sition was heard. The Board finds that the proposed extension will not be substantially more detrimental to the neighborhood than the existing non - conforming use. .d -2- (013 -85) 5. For the reasons and upon the basis set forth, the Board, by UNANIMOUS vote, hereby GRANTS Applicant the requested relief under SECTIONS 5 and 7I by SPECIAL PERMIT pursuant to SECTION 7F of the Zoning By -Law.
