Sherman, Acting Chairman BOARD OF APPEALS .. - •+►J TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing on WEDNESDAY, MARCH 13, 1985 at 1:30 p.m. in the Town and County Building, Nantucket, rendered the following decision in the Application o-f MARK GAFFNEY, Applicant and leasee of property owned by Joseph V. Arno (012 -85). _ 1. This is an Application for a SPECIAL PERMIT affording relief from the parking requirements of Zoning By -Law SECTION 6B. The premises are located at 27 EASY STREET, Plan 8594 C, zoned RESIDENTIAL - COMMERCIAL and having water frontage on the Easy Street Basin. Applicant, under a 1985 season lease from the owner, proposes to operate an outdoor ( "out- side") snack bar in daylight hours. Preparation and packaging of the food would be at another location of leasee Applicant. 2. Based on the record at the Hearing of February 15, 1985, we understand that Applicant has leased only an open portion of the premises shown in shading on the copy of a subdivision plan accompanying the Application form. No detailed showing is in the record. Generally the leased area fronts on the water, constitutes about one -half the backyard and all of the south side yard. An open porch may be included. We were told that patrons would have access to indoor toilet facilities. 3. The only driveway and premises area available for off - street parking or for loading facilities are in or adjacent the north side yard not leased to Applicant. We were told that at least two other businesses are conducted on the premises, an interior retail shop and, on the water front Erickson's sailboat rental. No provisions of off - street parking or loading for those were noted. We had been informed that the other leasees had been known to use the driveway. We were not informed as to possible claim of "grandfathering." 4. The recommendation of the Planning Board was unfavorable "be- cause parking is already limited in that area." Opposition was expressed by parties in interest through four (4) letters and testimony at the Hearing. None was favorable. Principal grounds of objection were the high density of traffic past the site and the dirth of on- street parking with risk of double parking and undue congestion. f � ..' ��012 =85) 5. With present direction of Easy and Broad Street, all traffic to the Steamship Wharf and all going northward via the eastern end of Broad Street must pass the premises. Minimal restriction of that traffic is vital to public convenience and safety, particularly in season when Applicant would operate. Accordingly, Special Permit relief would not be in harmony with the general purpose and intent of the By -Law. 6. Strong concern was expressed regarding litter and unsightliness attendant a take -out snack bar. Our exploration with Applicant of alter- native restaurant operations less likely-to be objectionable did not prove fruitful, considering lease limitations. Our actions at sites west of Easy Street noted by Applicant's attorney do not share sufficient commonality of circumstances to be helpful. 7. For the foregoing reasons, the Board voted UNANIMOUSLY to DENY the relief requested by Applicant. Dated: March 25, 1985 Nantucket, MA 02554 William R.
