Sherman, Acting Chairman I R TOWN OF NANTUCKET r BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the BOARD OF APPEALS held at 1:30 p.m. on FRIDAY, FEBRUARY 15, 1985, in the Town and County Building, ,,.-..11, ,Nantucket, the Application of S. WARREN KREBS AND ANNA JANE KREBS sbA"44..,), ., (011-85), whose address is 57 Union Street, Nantucket, was heard: -- 1. This is an Application for a SPECIAL PERMIT granting relief from SECTION 7 I (expansion or alteration of a pre- existing non- conforming structure) and a VARIANCE from SECTION 5 (intensity regu- lations) and SECTION 7 H (Variances) of the Zoning By -Law. If grantedi the Applicant would expand the first floor of his single family residence now on the 57 UNION STREET site by adding 195 square feet of ground cover across the rear of the house. The expansion is re- quested to allow the relocation of the existing owner's artist studio from the unheated attic to the first floor of the house, thus to continue a customary home occupation (Section 4 A l.d and 4 B). The property is located in a RESIDENTIAL -1 Zoning District. 2. Based upon a review of the Application, supporting docu- ments, plans, testimony and letters, the Board finds that the increase in ground cover from 29% to 33.5% and the necessary attendant rehab- ilitation and improvement of the building, would be in harmony with the general purposes and intent of the Zoning By -Law. The Planning Board recommended favorable action and no opposition was heard. The Board finds that the proposed extension would not be substantially more detrimental to the neighborhood. 3. Variance relief may be granted to further permit the Applicant to increase the ground cover ratio from 29% to 33.5% under Section 7 H of the Zoning By -Law. 4. The Board finds that due to the size and shape of the lot and buildings thereon which specifically affects said property, a literal enforsement of the By -Law would involve substantial hardship -2- 40.1 -85) to the Applicant.
