Cahoon, Chairman TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a Public Hearing of the FEBRUARY 1, 1985 at 1:30 p.m. and 1985 at 1:00 p.m. in the Town and matter of the Application of DOUG a SPECIAL PERMIT under SECTION 6B By -Law, the Board finds: BOARD OF APPEALS held on FRIDAY, continued to MONDAY, FEBRUARY 49 County Building, Nantucket, in the LAS THOMPSON ET AL (007 -85) seeking (parking requirements) of the Zoning 1. The property is located at 22 BROAD STREET, Lot 34, Plan 4242, zoned RESIDENTIAL- COMMERCIAL. Its most recent use is as follows: a) one apartment on the third floor; b) two apartments on the second floor; c) one apartment and an attorney's office on the first floor; d) in the summertime paintings and pictures were displayed on the outside of the building and retail sales of these pictures were con- ducted in the side yard. There has never been any off - street parking provided for any of these uses. 2. Based upon a review of the Application, testimony and repre- sentations at the Hearing, the Board makes the following findings: a) Applicants have contracted to sell the property to a third party who intends to make renovations, without extending any exterior dimensions, improve the appear- ance of the building and alter its use. The new uses will be as follows: i) The apartment on the third floor will remain. ii) The second floor will have three offices and one common reception area. iii)The first floor will have two retail stores, both of which will have their entrance through a new door on the side of the building so as not to disturb or destroy the front facade of the building facing Broad Street. (007 -85) -2- iv) There will be no pictures or anything else for sale hanging on the outside of the building and no retail sales will be allowed in the yard, or from the basement. v) The proposed renovations and new use will enhance the aesthetic and historical aspects of the neigh- borhood and the new uses are completely consistent with the commercial uses surrounding this piece of property. vi) The only off - street parking that could be provided would be in the side yard and it would be practi- cally impossible to provide any usable off - street parking due to the size and shape of the lot and due to the fact that it would be necessary to make a curb cut on Broad Street and do away with a usa- ble parallel parking space that currently exists. vii)The proposed new uses, without provision of the required parking spaces, would be in harmony with the intent and spirit of the By -Law. 3. Therefore, the Board, upon motion duly made and seconded, UNANIMOUSLY votes to GRANT Applicants a SPECIAL PERMIT exempting them from the requirements of providing nine off - street parking spaces for property located at 22 BROAD STREET when the proposed improvements and new uses are put into effect. BOARD'S DECISION Application submitted to Board Advertising dates Hearing date(s) Decision of Board Decision filed with the Town Clerk f RIDER A The Applicants, Douglas Thompson, Howard Hess, Betty Lou Foster, Robert LeBaron, Jean Ives and Althea Thompson are the owners of 22 Broad Street, Nantucket, Massachusetts 02554. The Applicants inherited the property from Lulu S. Emmons. The property contains approximately 2,732 square feet and is situated inside the core of the downtown Historic District. At this time, the building on the premises includes an office on the first floor, and apartments on the first, second and third floor. There is also an art gallery located in the patio area on the easterly side of the building. The building needs a significant amount of rennovation and upkeeping. The Applicants have agreed to sell the property and the prospective Buyer wishes to convert the office space on the first floor to a retail antique shop. There are no plans to alter or expand the exterior structure of the building. The Applicants seek a special permit waiving the off street parking requirements set forth in Section 6B of the Nantucket Zoning By -Law for a retail shop. The approximate area of the proposed retail shop is 600 square feet; required off street parking for this area is three (3) spaces. Because the lot area is small, it is impossible to provide the required off street parking. The premises are located in a downtown commercial area; most customers walk, rather than drive, to shop in this area. The requested waiver of off street parking will enable the prospective buyer to rennovate and improve the condition of the building, thereby enhancing the historic neighborhood. The requested relief will not be substantially more detrimental to the neighborhood than the current use of the building. For the reasons set forth, the Applicants respectfully request the Nantucket Board of Appeals to issue a special permit waiving off street parking requirements for 22 Broad Street.
