Enclosed, please find notice of a decision of the BOARD
OF APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and shall
be filed within twenty (20) days after this date.

DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FIRDAY,
FEBRUARY 11 1985 at 1:30 p.m. in the Town and County Building,
Nantucket, in the matter of the Application of THOMAS AND ANN SOLLAS
(003 -85), address850 Clayton Avenue, Bayhead, NJ 08742, the Board
finds:
1. This is an Application under SECTION 71 wherein the Appli-
cants seek a SPECIAL PERMIT to construct an addition on their resi-
dence located at 8 QUINCE STREET, Lot 1, Plan Book 18, Page 144,
zoned RESIDENTIAL -OLD- HISTORIC. The Applicants' lot is a pre- existing
non - conforming lot. containing 2464 square feet and as such the
Applicants are allowed 739.20 square feet of ground cover. Applicants'
existing structure covers 872 square feet and the proposed addition
covers 365 square feet.
2. Based upon a review of the Application, plans, testimony
for and against the proposal at the Hearing, the Board made the
following findings:
a) The proposed addition was not minor but, given the
small size of the lot, constituted a major and
significant expansion.
b) The building is located within the original Old -
Historic District of Nantucket and is an historic
building in that it was the Pence School and enjoys
an historic past.
c) The Applicants were aware of the limitations and
constraints on the size of their dwelling when they
purchased the property in the summer of 1984 and they
offered little evidence that this request was within
the spirit and intent of the By -Law.

d) The proposed extension is substantially more detri-
mental to the neighborhood than the existing non-
conforming structure.
3. Therefore, after motion was made and seconded, the Board,
by UNANIMOUS vote, DENIES the requested relief under SECTION 7I.

NOTICE

COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the
Application of THOMAS AND ANN SOLLAS (003 -85) seeking a SPECIAL
PERMIT under SECTION 7I (expansion of a pre- existing noncon-
forming use) of the Zoning By -Law. If granted, the Applicants
would be allowed to construct a small addition onto the house,
said addition to run 16' along the Northerly boundary and 17'
along the Westerly. The property is located at 8 QUINCE STREET,
LOT 19 PLAN BOOK 189 PAGE 144, and is zoned RESIDENTIAL -OLD
HISTORIC.
