DECISION:
At a Public Hearing of the BOARD OF APPEALS held on FRIDAY,
FEBRUARY 12 1985 at 1:30 p.m. and continued to MONDAY, FEBRUARY 4,
1985 at 1:00 p.m. in the Town and County Building, Nantucket, on the
matter of the Application of JEAN R. TRIFERO (001 -85), the Board
finds:
1. This is an Application for a SPECIAL PERMIT under SECTION
4A 3.b (accessory apartments ) of the Zoning By -Law. Applicant
wishes to construct an addition on her owner occupied home, containing
a one bedroom apartment. The property is located at MEADOW DRIVE,
Assessor's Sheet 56, Parcel 149, Lot 78, Plan LC 14830 U Cert 9603
and is zoned RESIDENTIAL -2.
2. Based upon a review of the Application, plans, testimony
and representations at the Hearing, the Board finds that the property
is located in an area of single - family home character and the
Applicant represented that she wished to keep that character intact
}
with the design of her addition, and she will live in the main body
of the dwelling as a year -round resident. The Applicant stated her
intention is to provide an affordable year -round (not - seasonal) rental,
meeting her own needs for suphmental income to cover the costs of
maintaining a home for herself. The Board further finds that the lot
size was not an issue in this matter. Approved septic plans for the
addition were also introduced.
3. Accordingly, the Board finds that the proposed structural
addition and use are in harmony with the general purpose and intent
of the By -Law. Therefore, the Board, by UNANIMOUS vote, GRANTS the
SPECIAL PERMIT under SECTION 4 A 3 (b) subject to the conditions set
forth:
The Applicant, her successors in interest and others claiming
under her, shall fully and continuously comply with each and all of
the standards specified in the Zoning By -Law concerning accessory

apartments, specifically:
1) unit size
2) interior design
3) exterior design
4) two off - street parking spaces, one for the principal
residence and one for the apartment.
5) single ownership
6) no further dwelling units on the lot
7) year -round occupancy evidenced by:
i) a restriction on prescribed form, recorded
against the deed
ii)affidavits in prescribed form filed as and when
due.
In the event the accessory apartment is offered for lease or
rental on a seasonal basis, the SPECIAL PERMIT shall be NULL and VOID.
