DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, DEC-
EMBER 14, 1984 at 1:30 p.m. in the Town and County Building, Nantucket,
made the following Decision in the Application of SCOTT STEARNS (096 -84),
address 153 Longmeadow Street, Longmeadow, MA 01106:
1. This is an Application for a SPECIAL PERMIT under SECTION 71
(extension of a pre- existing non - conforming use) for relief from the
provisions of SECTION 5 of the By -Law (intensity regulations). Alterna-
tive relief by Variance from Section 5 is asked for but deemed under the
circumstances set forth below to be not applicable. The property is lo-
cated at 15 UNION STREET, PLAN NO. 13785 -A, TAX MAP NO. 4232 -072 and is
in Zoning District RESIDENTIAL OLD HISTORIC.
2. From review of the Application, testimony, representations and
letters of record, the Board finds that Applicant purposes a dining room
addition to his single - family residence which predates the By -Law. The
addition would partially in -fill the southwest corner of the building
and encroach upon the south side lot line setback, 5 feet in ROH. The
existing south wall of the building, said to date from 1795, runs along
the south lot line except at the infilled corner. Since the proposed
addition or in- filled area will have a south wall set 3 feet back from
the south lot line, it will be less non - conforming.
3. We are informed that the south side abuttor had no objection
and the north side abuttor expressed approval at the Hearing. The addi-
tion has approval of the Historic District Commission, we are advised,
and the Planning Board recommends favorable action. No contrary position
was heard.
4. The proposed addition, as extension of a pre - existing non-
conforming use, is neither more non - conforming in distance nor substan-
tially more detrimental to the neighborhood but, to the contrary, will
have a beneficial impact in aesthetic effect. The addition is in harmony
('096 -84)

with the intent and purpose of the By -Law.
5. Accordingly,"by UNANIMOUS vote, the Board hereby GRANTS the
Applicant the SPECIAL PERMIT pursuant to SECTION 71 providing relief
P from SECTION 5 to the extent required for the ad.di4jon set forth in the
Application.

NOTICE
A Public Hearing of the BOARD OF APPEALS will be held
on FRIDAY, DECEMBER 14, 1984 at 1:30 p.m. in the TOWN AND
COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the
Application of SCOTT STEARNS (096 -84) seeking a SPECIAL PERMIT
under SECTION 71 (alteration or expansion of pre- existing non-
conforming use) for relief from the set back requirements of
SECTION 5 or in the alternative a VARIANCE from SECTION 5. If
granted, the Applicant would be allowed to add on to the dining
room area. The present structure already encroaches on the 5(five)
foot set back area and the addition would increase the encroach-
ment. The property is located at 15 UNION STREET, PLAN 13785 -A
TAX MA-P 4232 -072 and is zoned RESIDENTIAL OLD HISTORIC.
