DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, DEC-
EMBER 14, 1984 at 1:30 p.m. in the Town and County Building, Nantucket,
made the following Decision in the Application of EVA AND HERBERT MOSS
(094 -84), address 845 Field Avenue, Plainfield, NJ 07060:

1. This is an Application for a SPECIAL PERMIT under SECTION 71
(extension of a pre- existing non- conforming use) of the By -Law for relief
from the provisions of SECTION 5 (intensity regulations), specifically
side lot setback and ground cover ratio. The property is located at 7
PLUMB LANE, LOT 195.1, TAX MAP 42.3.2 and is in Zoning District RESIDEN-
TIAL OLD HISTORIC.
2. From review of the Application, testimony, representations and
letters of record, the Board finds that Applicant proposes a living room
addition in conjunction with remodeling a single- family residence which
might now be characterized as a garage- apartment. The existing single -
car garage is to become the living room. The existing structure predates
the By -Law. It served as the garage for the westerly abuttor until sub-
division made the west side lot line too close for automobile access to
the interior. Recent use of the garage has been for miscellaneous storage.
3. Applicant's attorney, by letter of November 29, 1984 and at the
Hearing, presented an amended proposal. The present west wall (the garage
entry) is set back from the west side lot line about 3'6" at the nearest
point. By the amended proposal, that wall is shifted easterly about 6 ".
When extended on its northwest corner by the proposed addition, the re-
sulting encroachment on the west side lot line setback is no greater than
presently exists. In keeping with the provisions of Section 71, we find
that the non - conforming distance is not made more non - conforming.

4. By the amended proposal, the Board understands that the pre-
sent ground cover ratio 47.7% is increased only to 48.9 %. We are pre-
pared to grant relief for a minor increase over the existing ground
cover ratio. In the ROH district, minimum lot size is 5,000 square feet
whereas the present lot is somewhat in excess of 1,000 square feet.
According to Section 5, allowable cover is 30% of the actual lot area
when undersized with a previously built structure.
5. No objections were heard. The Planning Board recommendation
was favorable.
6. The proposed addition, as amended, is neither more non- conform-
ing in distance nor substantially more detrimental to the neighborhood.
To the contrary, replacement of the garage door and related change will
have a beneficial impact in aesthetic effect.
7. Accordingly, by UNANIMOUS vote, the Board hereby issues the
SPECIAL PERMIT pursuant to SECTION 71 providing relief from SECTION 5
to the extent required for the addition set forth in the Application as
amended.
