Eileen I3 Cahoon, Chairman i TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, NOVEM- BER 30, 1984 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision in the Application of LUCILLE A. JORDAN, RICHARD S. SYLVIA AND MARIO TEIXEIRA (088 -84) for relief under By -Law SECTIONS 5 and 7I: 1. Applicants seek a SPECIAL PERMIT under SECTION 71 to extend a pre- existing non- conforming use of their Lot 1, Book 15, Page 99, at 8 FEDERAL STREET that is zoned RESIDENTIAL - COMMERCIAL. They wish to add a second building fronting on Federal Street and as the new building would share party walls not only with their present building but also with an abutter's building along their south side lot line, they also seek relief from the SECTION 5,,side -line setback requirements. No Application was made for relief from the requirements of Section 6B and specifically subsections 1, 3 as amended, 7 and 9 as amended. 2. Based upon the Application, drawings of the proposed building showing approval by the Historic District Commission, testimony, repre- sentations and letters in the record, the Board finds that the subject lot's area is 2580 square feet, while applicable minimum lot size for the R -C District is 5000 square feet. The present building which,lnsame or similar form predates the By -Law, encroaches upon the north side lot line setback. Accordingly, there is a pre- existing non - conforming use. 3. Applicants note that the proposed building is designed as a replica of a prior building pre- dating the Great Fire of 1846. Acknow- ledging that no such building has stood on the proposed site for more than 3 years (713), they urge that the proposed building would contri- bute to the neighborhood and its historic character. Proposed use is as a retail store. (088 -84) -2- • 4. While evidence was offered of favorable neighborhood senti- ment, a letter and testimony of the south lot line abutter voiced strong opposition. In particular, creation of an opaque party wall on the south side lot line was objected to as blocking light and air for 5 north - facing windows. Other letters and testimony expressed objection to in- creased density of use and loss of air space existing between buildings along Federal Street. The Planning Board recommended unfavorable action. 5. According to testimony, Applicants recently paid market price for the property in question, hence inability to add the new building is not a financial hardship. The present open space was not claimed to be unique in being the site of a former historic building. The proposed extended use is preponderantly more detrimental to the neighborhood than the existing non - conforming use. 6. For these reasons, the requested relief is DENIED, two members voting for denial of relief and one member failing to vote.
