DECISION:
At a meeting of the BOARD OF APPEALS held on Friday, November
16, 1984 in the Town and County Building, Federal and Broad Streets,
Nantucket, in the matter of the Application of HUDSON HOLLNAD, JR.
AND EDWARD F. VAUGHAN (086 -84), the Board finds:
1. This is an Application for a VARIANCE for relief from SECTION
6 B7 of the Zoning By -Law (off- street parking requirements). The Appli-
cants seek VARIANCE relief to expand an office building situated on
WHALER'S LANE, without commensurate increase in off - street parking.
The subject property is zoned RESIDENTIAL - COMMERCIAL.
2. Based upon review of the Application, supporting plans,
letters and testimony at the Public Hearing, the Board finds that the
subject property is an office building situated on a small, side
street abutting the core downtown area; that there is minimal vehicular
traffic on Whaler's Lane, that the premises are unlike other commercial
structures in the downtown area in that it already offers substantial
off - street parking, has a lawn and is bordered on the north end by a
stone fence. An increase in off - street parking would require the elimi-
nation of the stone fence, the grassed area and fruit tree and at least
two other tress. Accordingly, it is the view of the Board that owing
to the shape of such land and structures which set them apart from other
commercial properties in the area a literal enforsement of the By -Law
would involve a substantial hardship and the Variance may be granted
without substantial detriment to the Public Good and will not derogate
from the intent or purpose of the By -Law. In Fact, the Board feels that
the alternative in this case, tearing down the fence, etc., would be
detrimental to the downtown area generally.
3. For the reasons set forth above, the BOARD hereby GRANTS the
Applicants a VARIANCE waiving the off - street parking requirements set
forth in SECTION 6B7 of the Zoning By -Law.
