Rickard, Chairman TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, NOVEMBER 2, 1984 at 1:30 p.m. in the TOWN AND COUNTY BUILDING, NANTUCKET, made the following decision in the Application of NAN- TUCKET ISLAND REALTY TRUST (077 -84), address c/o Bill Cameron, Swain Street, Nantucket: 1. This is an Application for a VARIANCE under Zoning By -Law SECTION 139 -16 (formerly 5), intensity regulations and specifically PARAGRAPH C, concerning set -back from a lot line. The granting of relief would enable the Applicant to extend a new construction,ie. a deck, closer to the lot line along Cornish Street than the 5(five) foot rear or side lot set -back specified forthe Residential -1 Dis- trict. Specifically, the Applicant wishes to extend the decks to the lot line with no set -back. 2. From a review of the Application, drawings L1 and A1-5 of the Brant Point Courtyard by Paul J. Donnelly Architects, represent- ations of Applicant's attorney, the Board finds that the subject property is now under a Special Permit granted by this Board some time in the past. Applicant proposes to replace a dilapidated eight - unit one -story building with a new two -story structure having no more than eight dwelling units as limited by said Special Permit. That structure, in conformity with the Donnelly plans, would have res- pective decks extending from each of 5(five) ground -floor units to- ward the Cornish Street lot line. Fences, subject to HDC approval, running on either side of said decks, would provide visual separation and privacy, defining for each unit a small outdoor patio area. 3. To provide the proposed patio areas without encroaching on the set -back, Applicant would have to site the structure further from Cornish Street. Only a short time remains in 1984 for constructing foundations. Established foundation plantings would also be displaced. 4. At the Hearing, offer was made to provide visual screening between the patio areas and the Cornish Street lot line if a Variance were granted requiring only a two -foot set -bsck. -2- (077-84) 5. The Planning Board gave an unfavorable recommendation as they were lacking the benefit of the Donnelly plans. No further adverse position was heard. 6. The lot in question is of an odd shape unique to the dis- trict with the rear of the proposed structure closely confronting the back of a relatively unattractive automobile agency building. Proposed relief would be uniquely applicable to the subject property. 7. Accordingly, the Board, by UNANIMOUS vote, hereby GRANTS to the Applicant a VARIANCE allowing construction according to the Donnelly plans , of the patio deck areas with only a two -foot set -back along the Cornish Street lot line, under the condition that adequate visual screening be provided. This is done without substantial detri- ment to the Public Good and without nullifying or substantially dero- gating from the intent or purpose of the By -Law.
