DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, NOV-
EMBER 30, 1984 at 1:30 p.m. in the Town and County Building, Nantucket,
made the following Decision in the matter of AIRPORT CAR WASH, INC.,
lessee, Applicant (Nantucket Airport Commission -owner with address on
Macy Lane, Nantucket, MA 02554) (075 -84):
1. This is an Application for a SPECIAL PERMIT requesting relief
pursuant to SECTION 4 C 2 (4) and (7) of the Zoning By -Law for property
located in a RESIDENTIAL - COMMERCIAL District. If granted, the Applicant
proposes to use the site for a gasoline station and car wash.
2. Based upon a review of the Application, supporting documents,
plans, testimony and knowledge pf the site, the Board finds that the use
of the premises for the above commercial purposes sought by Special
Permit relief is in harmony with the general purposes and intent of the
Zoning By -Law and the relief may be granted without substantial detri-
ment to the Public Good and without nullifying or derogating from the
intent or purpose of the By -Law. The Board further finds that the in-
tended use will not be in violation of SECTION 6D of the Zoning By -Law.
Further the Board feels that the use would be in harmony with the sur-
rounding area with the Airport and several commercial businesses located
nearby.
3. Applicant's representative at the Hearing noted that the pro-
posed Nobadeer Inn, with the Airport, would set a level of traffic not
substantially impacted by Applicant's proposed activity. Applicant would
dispose of waste water (made minimal, e.g. much less than 5 -7 gallons
per car by recycling process) either through the Airport or Inn system
and tie -in to the Town system when reasonably available. If needed,
holding tanks and nighttime pumping would be provided. Underground storage
tanks would meet proposed Island regulations, if economically feasible,
although not then in force. -=

4. The Board imposes the following conditions upon the granting
of the Special Permit relief:
a. The Applicant shall provide landscape screening along the side
and rear lot lines of the area leased to Applicant for the approved
purposes;
b. the Applicant shall promptly use reasonable efforts to obtain
the necessary permits to connect to the Town of Nantucket sewer system,
when said system becomes available for use from the above leased area;
c. The Applicant shall install all utility service lines under-
ground;
d. The Applicant shall provide asphalt paving in accordance with
current specifications of the Subdivision Control Regulations to sur-
face areas to be used by cars.
e. The Applicant shall provide effective electrolytic (cathodic
or anodic) protection for underground storage tanks, if of steel, and
shall otherwise comply with legally applicable regulations, notably,
M.G.L. Chapter 148, Section 13`for gasoline storage facilities.
5. For the reasons stated and upon the conditions set forth here-
in, the Board hereby GRANTS the Applicant SPECIAL PERMIT relief under
SECTION 4 C 2 (4) and (7) pursuant to SECTION 7F, by a UNANIMOUS vote.

COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the
Application of AIRPORT CAR WASH, INC., LESSEE, APPLICANT,
NANTUCKET AIRPORT COMMISSION, OWNER (075 -84) seeking a SPECIAL
PERMIT under SECTION 7F allowing uses under SECTION 4 C 2 (4),
(7) of the Zoning By -Law. If granted, the Applicant would be
permitted to construct and operate a car wash and gas station
(garage). The property is located at MACY'S LANE, LOT D 5,
LAND COURT PLAN 14342 -C and is zoned RESIDENTIAL - COMMERCIAL.
