Enclosed, please find notice of a decision of the BOARD
OF APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and shall
be filed within twenty (20) days after this date.

DECISION:
At a meeting of the BOARD OF APPEALS held on September 28,
1984 at 1:30 p.m. in the Town and County Building, Nantucket, in the
matter of the Application of DAVID AND CHRISTINA VISCO (071 -84)9
the Board finds:
1. This is an Application for a SPECIAL PERMIT under Section
5.3 (side -line set back) of the Zoning By -Law. The Applicants wish
to enlarge their single family home by adding on to their kitchen
and family area at their dwelling on #10 Helen's Drive, Lot 24,
Plan Book 2143.
2. The Applicants have a growing family and the only logical
and aesthetimly pleasing way to build the addition would encroach on
their allowed side -line set back of 10 (ten) feet. The Applicant
wishes to extend approximately 4 (four) feet into that set back area.
3. There was support from the abutters and the Planning Board
reicommended favorable action. The Board also noted that in the
Residential -2 T)istrict in which this dwelling is situated the Board
of Appeals has the power to decrease the set back requirements from
10 (ten) feet to 5 (five) feet. With this allowed reduction the
proposed addition would, at its nearest point, be 6 (six) feet from
the side -line.
4. Accordingly, the Board finds that the proposed addition
and use are in harmony with the general purpose and intent of the By-
Law and after a review of the Application, plans, testimony and
representations at the Hearing, the Board, by UNANIMOUS vote, GRANTS
the SPECIAL PERMIT under Section 5.3 of the Zoning By -Law.

held on FRIDAY, SEPTEMBER 28, 1984 at 1:30 p.m. in the
TOWN AND COUNTY BUILDING, FEDERAL AND BROAD STREETS,
NANTUCKET, on the Application of DAVID AND CHRISTINA VISCO
(071 -84) seeking a SPECIAL PERMIT or a VARIANCE from
SECTION 7 I (extension of a pre- existing non - conforming use)
and SECTION 5 (3) (side -line set beck) of the Zoning By -Law.
If granted, the Applicants would be able to expand a
kitchen and family area to accomodate a growing family,
in an existing year -round dwelling, located at #10 HELEN'S
DRIVE, Lot 24, Plan Book 2143 and is zoned RESIDENTIAL -2.
