Rickard, Chairman BOARD OF APPEALS TOWN AND NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a meeting of the BOARD OF APPEALS held on September 14, 1984 at 1:30 p.m. at the Town and County Building, Nantucket, in the matter of the Application of LENORE V. MARTIN (070 -84), the Board finds: 1. This is an Application for a MODIFICATION of a SPECIAL PERMIT. The original having been granted in September 1982 and numbered (021 -84). If total compliance with the terms set forth in the original decision had been made the Applicant would have provided three (3) parking spaces, off - street while extending a non- conforming use with the addition of three single guest house rooms at the location, 43 CENTRE STREET. ,2. Based upon the Application, viewings, testimony and repre- sentations at the Public Hearing, the Board finds that substantial use of the 1982 Special Permit was not made resulting in its expira- tion on September of 1983. Accordingly, this Application is properly treated as a request for a ney Special Permit under Section 7F and 71 of the Zoning By -Law, giving relief from Section 6B (parking require- ments). If granted, the Applicant could operate three added single rooms under a guest house license while providing only two parking spaces off Ash Lane. 3. The Board was informed that two parking spaces would likely meet guest needs and that a third space would encroach on an existing garden on the lot side fronting on Ash Lane. The owner maintained that the addition of the third sapce resulting in the demolition of the garden would greatly detract from the beauty of the surrounding area and the dwelling itself. This maintaining of said garden i$ in harmony with the historically important area, noting that the Jared Coffin House is an abutter, from which a letter in support was received. The Board noted that there was no adverse position heard. w -2- (070 -84) 4. The Board, acting in its discretionary capacity, finds that the extended use under the Special Permit requested, will be in harmony with the general purpose and intent of the By -Law and not substantially more detrimental to the neighborhood than the present non- conforming use. For the foregoing reasons, the Board, by UNANIMOUS vote, hereby GRANTS the Applicant a SPECIAL PERMIT giving relief from the parking requirements of SECTION 6B with the Applicant now required to provide two (2) parking spaces. The two spaces are to be provided off Ash Lane and the existing garden area shall be maintained as a garden.
