Ricka d, Cha'rman A 1 M TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a meeting of the BOARD OF APPEALS held on September 28, 1984 at 1:30 p.m. in the Town and County Building, Nantucket, in the matter of the Application of JAMES A. SHEPHARD, III. AND CAROLINE B. SHEPHARD (069 -84), the Board finds: 1) This is an Application for a SPECIAL PERMIT under Section 5 (intensity regulations) and Section 7I (extension of a pre- existing non - conforming use) of the Zoning By -Law. The Applicants own the property at Nine Broadway, Siasconset, Ma. They acquired the property in May of 1980 and it has been used and continues to be used as a single - family residence. However, the lot is a non -con- forming lot containing less than 5,000 SUare feet and for this reason any additions to the structure require a Special Permit pursuant to Section 71 of the Zoning By -Law. 2) The Applicants constructed a small addition, approximately 8 (eight) feet by 30 (thirty) inches on the back of their house to be used as a storage area for lawn mower, gardening tools and other incidental storage, without seeking a Special Permit or Building Permit before commencing the building of the structure. The plans for said addition were approved by the Historic District Commission. 3) The Board is convinced that in this case the Applicants acted in good faith and were ignorant of the need for the afore- mentioned Permits. Generally, this Board looks with extreem dis- favor on any building not done with the proper required Permits and its attitude in this case reflects its special facts and should not lead anyone to believe this Board will in the future allow illegal construction to be made legal. -2- (069 -84) 4) The Applicants have renovated and improved the appearance of their home and grounds since they purchased the property in 1980 and this addition is in keeping with the residential character of the neighborhood and is aesthetically pleasing to the neighbors as it provides storage space for equipment and tools that would other- wise be left outside in open view. The addition does not extend out into the Public Way that exists between the house and the direct abbutter and thus does not obstruct passage to the bluff area. 5) For the reasons set forth, and based upon a review of the Application, plans, testimony and representations at the Hearing, the Board finds that the addition does not violate the spirit or intent of the Zoning By -Law and has a beneficial, as opposed to a detri- mental, effect on the neighborhood. Therefore, by UNANIMOUS vote, the Board hereby GRANTS the Applicants the SPECIAL PERMIT to permit the addition in accordance with the plans approved by the Historic District Commission.
