OF APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and shall
be filed within twenty (20) days after this date.

DECISION:
At a meeting of the BOARD OF APPEALS held on September 14, 1984
at 1:30 p.m. in the Town and County Building, Nantucket, in the matter
of the Application of ROXANA E. VIERA (067 -84) the Board finds:
1. This is an Application for a SPECIAL PERMIT under Section
7F and Section 4 A 3 (b) of the Zoning By -Law. The Applicant wishes to
construct a new single - family dwelling with an accessory apartment
integrated into the design from the inception of the structure. The
accessory apartment, and its future use are to meet the standards
specified in Section 4A3 (b).
2. Based upon a review of the Application, plans, testimony
and representations at the Hearing, the Board finds that the property
which is located at DOC RYDER'S DRIVE, MIACOMET, SMOOTH HUMMOCKS, LOT
108, LC 28933 -M, ASSESSOR'S SHEET 669 PARCEL 210, now has no dwelling
present. The locus is of a single - family home character and the
Applicant wishes to maintain that character with the design of the
dwelling. The home,having only one main entrance in the front, will
conform to those in the area. The Applicants stated intention is to
provide an affordable year -round (not seasonal) rental, meeting her
own needs for supplimental income to cover the costs of maintaining
a home for her family.
3. The FAVORABLE reccommendation of the Planning Board is found
to indicate adequate provisions for parking and utilities for the
home and apartment.
4. Accordingly, The Board finds that the proposed structure and
use are in harmony with the general purpose and intent of the By -Law.
Therefore the Board, by UNANIMOUS vote, GRANTS the SPECIAL PERMIT under
Section 4 A 3 (b) subject to the conditions set forth:
The Applicant, her successors in interst and others claiming
under her, shall fully and continuously comply with each and all of the
standards specified in the Zoning By -LAw concerning accessory apart -
mentsj specifically:
1) unit size
2) interior design

4) two off - street parking spaces, one for the principal
residence and one for the apartment.
5) single ownership
6) no further dwelling units on the lot
7) year -round occupancy evidenced by
(i) a restriction on prescribed form, recorded
against the deed
(ii) affidavits in prescribed form filed as and
when due.
In the event the accessory apartment is offered for lease or
rent on a seasonal basis, the SPECIAL PERMIT shall be null and void.

COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the
Application of ROXANA E. VIERA (067 -84) seeking a SPECIAL
PERMIT under SECTION 4(A)3 (year -round accessory apartments,
exception) of the Zoning By -Law. If granted, the Applicant
would be permitted to add an accessory apartment to a proposed
dwelling, subject to the conditions of Section 4(A)3. The
premises are located on DOC RYDER'S DRIVE, MIACOMET, SMOOTH
