OF APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and shall
be filed within twenty(20) days after this date.

5. For the reasons set forth the Board finds that this change
of use will not be substantially more detrimental to the neighborhood
than the existing use, in fact the Board finds that this new use will
be a marked improvement to the neighborhood. therefore the Board, by
Unanimous vote, hereby GRANTS the SPECIAL PERMIT to allow the altera-
tion of the non - conforming use as outlined above, subject only to the
provisions that the ingress and egress to Lot 2 be in conformance with
the recommendations of the Traffic Safety Committee.

DECISION:
At a meeting of the BOARD OF APPEALS held on Friday, August
17, 1984 in the Town and County Building, Nantucket on the matter of
the Application of DONALD AND PHYLLIS VISCO (066 -84), the Board finds:
1. This is an Application for a Special Permit under Section
7.I.(1) of the Zoning By -Law seeking to alter a non - conforming use
of property, being shown as Lot 14 on a plan drawn up by Josiah S.
Barrett. the Premises are located at the corner of Orange Street and
Gold Star Drive.
2. At the present time the property, although located in an
R -10 zoning district, is used by Island Excavating Company for a
construction business specializing in the installation and maintenance
of septic systems and road building. This present use involves outside
storage of gravel, septic tanks and much heavy -duty construction
equiument but is allowed because it pre -dates zoning.
3. The Applicants wish to sell their property to Mr. and Mrs.
Zaharias Karyotakis who wish to change the non - conforming use of the
property. They wish to build a building with a wood- working shop in the
basement (Mr. Karyotakis makes custom made cabinets and furniture),
a work area for Mrs. Karyotakis and employees,for the making of custom
made draperies, slipcovers and other like items on the first floor, a
showroom and sales area for these products on the first floor, and an
apartment on the second floor to house Mrs. Karyotakis' employees.
4. The proposed new use will comply with all rules and regulations
relative to Historic District Commission Approval, ground cover, set-
backs and parking requirements and the anticipated traffic to the new
building is very low as this is not a high intensity use but is
really more in the nature of a home - occupation.

Please be advised that at a meeting of the Traffic Safety Committee
held August 29, 1984 the Committee voted to recommend the following
action to the Board of Appeals:
That vehicular access to the property be provided through a
driveway installed off Orange Street rather- than from Gold Star
Drive. The Committee finds that access from Gold Star Drive would
pose a safety hazard to those living on this predominently
residential street, especially children.

NOTICE
A Public Hearing of the BOARD OF APPEALS will be held on
Friday, August 17, 1984 at 1:30 p.m. in the TOWN AND COUNTY
BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the Application
of DONALD AND PHYLLIS VISCO ( 066 -84) seeking relief from SECTION
7(I) (alteration of a pre- existing non - conforming use) of the
Zoning By -Law by a SPECIAL PERMIT. If granted, the Applicants
would be allowed to convert property used for a construction
business, specifically installing septic systems and road work,
to a retail custom -made furniture and drapery business. The
property is located on the CORNER OF OLD SOUTH ROAD AND GOLD STAR
DRIVE, LOT 70, Tax Map 55, and is zoned RESIDENTIAL -10.

Reason for asking relief: Applicant has a signed Purchase and Sales Agreement and
prospective buyers wish to operate a retail custom made furniture and drapery business
on the property. At the present time. the prrperty is used by Tsland Fxcavating
Company for a construction business specializing in installation of septic systems
and road work. This use is a pre - existing non - conforming use and this application
seeks a special permit to change the use to one that is much less offensive to the
neighbors and will upgrade the area.
