DECISION:
At a Meeting of the BOARD OF APPEALS held on November 2,
1984 at 1:30 p.m. in the Town and County Building, Nantucket, the
Board made the following decision in the Application of BRUCE E.
EVANS AND JILL M. EVANS (064 -84), address One Thurstons Way, Nan-
tucket:
1. This is an Application for a VARIANCE under Zoning By -Law
SECTION 139 -16 (formerly 5), intensity regulations, PARAGRAPH A,
ground cover ratio. If granted, Applicants would be able to build a
detached garage and so exceed the 1500 square feet ground cover max-
imum permitted them in the RESIDENTIAL -2 District. The premises are
located at ONE THURSTONS WAY, LOT 239 TAX MAP 66, PARCEL 31.
2. From a review of the Application, testimony, representations
and maps and plans submitted, the Board finds that the garage, as pro-
posed, together with the existing 2 bedroom house, would have a ground
cover of 1740 sq. ft. When the house was purchased in 1979, it was
zoned for a minimum 5,000 sq. ft.lot size, it has been rezoned since
then to 20,000 sq. ft. The lot, at a corner, is 10, 208 sq. ft.; is of
a generally trapezoidal shape, with a driveway from Thurstons Way ex-
tending too close to the rear lot line for a garage to be sited at its
end. The house lacks basement, attic or like storage as well as any
l laundry space. The heating apparatus is also located in the kitchen
due to the lack of space.
3. Applicants' proposed garage, according to HDC- approved
drawings, consists of a 24' by 26' principal space plus a 6' by 10'
laundry space, together with the deck, steps etc., not of concern in
determining ground cover ratio (139 -2). After continuances to Nov-
ember 2, 1984, the Applicants undertook to limit the added cover to
24' by 26', or 624 sq. ft., sufficient for their vehicle and miscel-
laneous storage requirements plus toilet space. Applicants, represented

By their attorney, affirmed that no living space (dwelling unit) was
intended or asked for.
4. The Planning Board recommendation was favorable. No abutter
or other objection was received.
5. The shape of the lot and the size and placement of the house
relative to the road intersection corner are circumstances unique to
Applicants' lot, not affecting, generally, the R -2 Zoning District. A
literal enforcement of the 1500 sq. ft. maximum ground cover would in-
volve substantial hardship and likely encourage unsightly outdoor ex-
posure of items otherwise to be stored in the garage.
6. Accordingly, the Board, by UNANIMOUS vote, GRANTS the re-
quested VARIANCE limited, however, to an added 624 sq. ft. for a total
1680 sq. ft. of ground cover. Such relief is granted without substantial
detriment to the Public Good and without nullifying or substantially
derogating from the intent and purpose of said By -Law.

COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the

a VARIANCE under SECTION 5 (intensity regulations- specifically
