TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a meeting of the Board of Appeals held at 1:30 p.m., Friday, August 17, 1984, in the Town and County Building, Nan- tucket, in the matter of the Application of Downeyflake, Inc. ( 060 -84 ), the Board finds: 1. This is an application for a Special Permit for relief pursuant to Section 7I (Special Permits) (expansion of pre - existing, non - conforming structure) and a Variance from Section 5 (Intensity Regulations) pursuant to Section 7 H (Variances) of the Zoning By -Law. If granted, the applicant will add a second story dwelling and extend the building now on the site by adding 57± square feet. The existing building is non - conforming and encroaches within the allowed side -line set backs. The Applicant proposes to make the building less non- conform- ing as to the side -line set back on the Chestnut Street side of the building and to extend the pre- existing non - conforming side -line set back on the northerly side of the building. 2. Based upon a review of the Application, supporting doc- uments, plans, testimony and knowledge of the site, the Board finds that the expansion of the building with an added second story dwel- ling and extension of non - conforming side -line set back with the necessary attendant rehabilitation and improvement of the building would be in harmony with the general purposes and intent of the Zoning By -Law r TOWN OF NANTUCKET BOARD OF APPEALS DECISION 3. Variance relief is granted to permit the applicant to increase ground cover ratio by adding 57± square feet to the existing ground cover on the lot. The Board finds that due to the size and shape of the lot and buildings thereon, and the encroachment of the existing building over the street line, a literal enforcement of the By -Law would involve substantial hardship to the applicant. The requested relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such By -Law. 4. The Board finds that the applicant's proposed plans will reguire one (1) on -site parking space and otherwise grants special permit relief from Section 6B (Parking Requirements) of the Zoning By -Law. 5. For the reasons and upon the conditions set forth herein, the Board hereby GRANTS the Applicant relief from Section 5, and 6B pursuant to Section 7I and 7H, for Special Permit and Variance relief respectively, by UNANIMOUS vote.
