OF APPEALS which has this day been filed with the Town

Any appeal from this action shall be made pursuant to
Section 17 of the Chapter 40A of the General Laws, and
shall be filed within twenty(20) days after this date.

DECISION:
At a meeting of the BOARD OF APPEALS held at 1:30 p.m.
Friday, July 13, 1984 in the Town and County Building, Nan-
tucket, in the matter of the Application of THOMAS V. AND
LILLIAN B. LEFAVRE (056 -84), the BOARD finds:
1. This is an Application for a VARIANCE under Section 4
(A) (1) (b) (2) (location of secondary dwellings) of the
Zoning By -Law. If granted, the Applicants would be permitted
to locate a guest cottage within 12 feet of a rear building
line because of the topography of the lot located on GARDNER
ROAD, SHIMMO, Lot 43, Land Court Plan 11461 -H, zoned LIMITED
USE - GENERAL 1.
2. Based upon a review of the Application, supporting
documents, plans, testimony, letters and a viewing of the site
the BOARD specifically finds that owing to circumstances re-
lating to the topography and shape of such land and structures,
and especially affecting such land and structures but not
affecting generally the zoning district in which it is located,
a literal enforcement of the provisions of the By -Law would
involve substantial hardship, financial or otherwise, to the
petitioner or appellant and it is in harmony with the intent
and purposes of the Zoning By -Law. The BOARD also notes that
there was a favorable reccommendation from the Planning Board.
3. For the reasons and upon the conditions set forth, the
BOARD hereby GRANTS the Applicant relief under Section 4 (A)
(1) (b) (2) of the Zoning By -Law by a VARIANCE, by UNANIMOUS
vote.
