Rickard, Chairman BOARD OF APPEALS � a TOWN OF NANTUCKET B 0 A R D O F A P P E A L S Nantucket, Massachusetts 02554 DECISION: At a meeting of the BOARD OF APPEALS held on Friday, July 6, 1984 in the Town and County Building in the matter of the Application of MARILYN (COCCOLUTO) BERTIIELETTF., WILLIAM YUNDT AND E. FLORENCE YUNDT ( 053 -84 ) , the BOARD finds: 1. This is an Application for a VARIANCE from the requirements in Section 5 (intensity regulations) of the Zoning By -Law so as to cure zoning non - conformities which adversely affect the marketability of title to the property. The premises is located at Quince and Westminster Streets and is zoned RESIDENTIAL OLD HISTORIC. 2. The owner subdivided the property and received Approval Not Required endorsement from the Planning Board on August 23, 1982 and recorded their plan in the Registry of Deeds on September 20, 1983 in Book 22, Page 60. The subdivision was pursuant to Chapter 41, Section 81 L of the General Laws, permitting the subdivision of a lot containing two dwellings which antedate the introduction of subdivision control. They, of course, also antedate the enactment of the Zoning By -Law on Nantucket. Today, we are asked to deal with the resulting Lot 1 which is non - conforming as to rear line setback, westerly line setback and as to area. These non - conformities could adversely affect the marketability of title to Lot 1 and impose severe financial hard- ship upon the Applicants. 3. For the reasons set forth, the BOARD finds that a literal enforcement of the Zoning By -Law would involve substantial hardship and that the desired relief may be granted without substantial detriment to the public -2- good and without nullifying or substantially derogating from the intent or purpose of the By -Law. Consequently, the BOARD hereby GRANTS the Applicant a Variance from the requirements of Section 5 of the Zoning By -Law with regard to the aforementioned setbacks and area, by UNANIMOUS vote.
