1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law (the `By- law ") Section 139- 33.A(1)(b) that
the proposed alterations to the pre- existing, nonconforming structure on a conforming lot will
not increase the nonconforming nature of the structure and will not create any new
nonconformities.
2. The Applicant proposes to relocate and rebuild the dwelling's entry from its existing
location on the southern elevation to a location slightly to the west in the garage gable portion of
the structure. The existing stoop and overhang are sited as close as nine (9) feet from the
southerly front yard lot line abutting Walsh Street. The proposed relocated stoop and overhang
will continue to be sited as close as, but no closer than nine (9) feet from the southerly lot line.
The project also consists of an addition and renovation to the west elevation of the pre- existing
nonconforming structure which will take place outside of the required ten foot setback distance,
and, therefore, does not require relief. All work shall be performed in accordance with Certificate
of Appropriateness No. 64125 issued by the Nantucket Historic District Commission, as the
same may be amended from time to time. The project has also been granted approval by the
Conservation Commission by virtue of Order of Conditions in MassDEP File # SE48 -2732, and
registered as Land Court Document 146889.
3. The Locus, as shown on plan entitled, "As -Built Plot Plan, Nantucket, Ma. ", prepared by
Joseph Marcklinger & Associates, Inc., dated October 24, 2013, and attached herewith as
"Exhibit A ", is comprised of 62 Hulbert Avenue, shown as Assessors Map 29, Parcel 57 and as
Lot 12 upon Land Court Plan 15800 -H, and as 61 Walsh Street, shown as Assessors Map 29,
Parcel 164 and as Lot 13 upon Land Court Plan 15800 -H. The lots are merged for zoning
purposes by virtue of common ownership and control by the applicant, Gracie Island, LLC, as
evidenced by deed registered as Land Court Document 146891.
The Locus has an approximate lot area of 19,609 square feet (Lot 12 contains ±12,108 square
feet and Lot 13 contains approximately ±7,500 square feet) in the Residential One (R- 1)zoning
district where minimum lot size is 5,000 square feet. The merged Locus has triple frontage on
Hulbert, Avenue to the north, Johnson Street to the west, and Walsh Street to the south. Pursuant
to By -law Section 139- 16.C(3), structures on a lot in the R -1 zoning district abutting two or more
streets or ways, whether constructed or not, must maintain the minimum ten (10) foot setback
from each street or way.

4. The subject structure, is a secondary dwelling ( "Guest House ") associated with a larger
primary dwelling situated at 62 Hulbert Avenue directly to the north. The existing combined
ground cover ratio is approximately 19% where a maximum of 30 %, equivalent to 5,882 square
feet of structural ground cover, is allowed.
5. Based upon the site plan entitled, "Proposed Site Plan; 62 Hulbert Avenue and 61 Walsh
Street ", prepared by Joseph Marcklinger & Associates, Inc., dated April 21, 2015, and attached
herewith as "Exhibit B ", the Zoning Administrator finds that the proposed work consisting of
removing and relocating the stoop and overhang entry from its current position, sited (9) feet
from the southerly lot line, to the more westerly garage gable portion of the structure at a
distance no closer than nine (9) feet from the southerly lot line, will not increase the
nonconforming nature of the structure, and will not create any new nonconformities and hereby
issues the permit as requested.
