1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law (the `By -law ") Section 139- 33.A(1)(b) that
the proposed extension, alteration, and change to the pre- existing, nonconforming structure on a
conforming lot will not increase the nonconforming nature of the structure and will not create
any new nonconformities.
2. The Applicant proposes to renovate the existing structure, including putting it on a new
foundation and constructing an addition, all in accordance with Certificate of Appropriateness
No. 64614 issued by the Nantucket Historic District Commission, as the same may be modified
and amended from time to time.
3. The Locus, as existing and as proposed, is conforming as to use, parking, and all
dimensional requirements of the By -law, except height. The Locus is located in the Village
Height Overlay District ( "VHOD ") under By -law Section 139 -4. Under By -law Section 139 -
12.K(1), the maximum height permitted within the VHOD is twenty -five (25) feet. Pursuant to
By -law Section 139- 12.K(2), the height limitation under By -law Section 139- 12.K(1) became
effective January 31, 2010. The existing structure on the Locus was constructed pursuant to a
building permit issued in 1980, with a Certificate of Occupancy issuing in 1990, and has a height
for zoning purposes of approximately 28.8 feet. As a result, the existing structure on the Locus
is a validly pre- existing, nonconforming structure as to height.
4. The following table sets forth the existing and proposed conditions of the Locus with
respect to the dimensional requirements of the By -law:

5. Based upon the site plan entitled, "ZBA EXHIBIT PLAN; #25 STARBUCK ROAD IN
NANTUCKET, MASSACHUSETTS ", prepared by Nantucket Surveyors, LLC, dated
November 3, 2015, a reduced copy of which is attached hereto as "Exhibit A ", showing existing
and proposed conditions on the Locus, the Zoning Administrator finds that the proposed work
will not increase the nonconforming nature of the structure and will not create any new
nonconformities and hereby issues the special permit as requested. Following its renovation and
expansion, the Locus will continue to be conforming as to use, parking, and all dimensional
requirements of the By -law, except height, as to which it is validly pre- existing, nonconforming,
and the nonconforming height will not become more nonconforming.
