1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(1)(b) that the proposed alteration, expansion, and structural change to the
pre- existing, non - conforming structure do not increase its nonconforming nature.
2. The Applicant proposes to alter the existing structure by building an
approximately seventy (70) square foot addition on the west elevation of the
dwelling, as permitted by the Historic District Commission in Certificate of
Appropriateness No. 63885. Applicant further proposes to add a set of basement
stairs on the north elevation of the dwelling, to be sited as close as 11.6 feet from
the front yard lot line.
3. The locus, shown as Lot 217 on record Plan No. 42 -N, has an approximate lot
area of 11,049 square feet in the R -10 zoning district where minimum required
lot area is 10,000 square feet. Lot 217 is comprised of Lease Area 217A and
Lease Area 217B, each sharing a common boundary and driveway and each
containing a single family dwelling. (Lease Area 217B contains a 1,315 square
foot single family dwelling, and is under separate ownership from the subject
structure, although both Lease Areas are controlled by the Nashaquisset
Cooperative, Inc.)
4. Lease Area 217A contains the subject 976 square foot structure and directly abuts
Autopscot Circle. The structure is pre- existing nonconforming as to front yard
setback distance, being sited as close as approximately 10.8 feet from the westerly
front yard lot line in a zoning district which requires a minimum twenty (20) foot
front yard setback, as shown on the plan entitled "Building Location Plan of
Land in Nantucket, Mass. ", prepared by Blackwell & Associates, Inc., dated May
28, 1993, a reduced copy of which is attached herewith as "Addendum A -1 ". The
proposed alterations will be sited no closer than the existing 10.8 feet from the
front yard lot line and, as such, will not increase the front yard setback intrusion.

5. The combined overall ground cover of the two dwellings on Lot 217 is
approximately 2,291 square feet, resulting in an existing ground cover ratio of
20.7% in a zoning district where maximum allowable ground cover ratio is 25 %.
The proposed seventy (70) square foot addition will result in a combined overall
ground cover of approximately 2,361 square feet, resulting in an proposed ground
cover ratio of 21.4 %.
6. Therefore, because the proposed alterations, as shown on the modified site plan
submitted with the application, will not increase the pre- existing nonconforming
front yard setback intrusion, the Zoning Administrator finds that the proposed
work will not increase the pre- existing nonconforming nature of the structure or
the Locus.
