1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law Section 139 -
33.A(1)(b) that the proposed alteration and structural change to the pre- existing
non - conforming structure do not increase its non - conforming nature.
2. The Applicant proposes to alter the pre- existing nonconforming dwelling. The
structure is sited within the westerly and easterly side yard setbacks and the
northerly rear yard setback. The work consists of raising the structure to remove
and replace a concrete block foundation and crawl space with a full basement.
The structure will be set back down on a new poured concrete foundation without
any change to the footprint or the height. A further alteration consists of adding
three basement window wells, two (2) on the north elevation and one (1) on the
west elevation of the dwelling. The proposed alterations will be no closer to the
side or rear yard lot lines than the existing structure, all in accordance with
Certificate of Appropriateness No. 64067 granted by the Nantucket Historic
District Commission.
3. The Locus, as shown on plan entitled, "Building Location Plan of Land in
Nantucket, Mass. ", dated June 15, 1993, prepared by Blackwell & Associates,
Inc., and attached herewith as "Exhibit A ", is an undersized lot of record having
an approximate lot area of 1,787 square feet in the Residential Old Historic
(ROH) zoning district which requires a minimum lot size of 5,000 square feet.
The locus is also pre- existing nonconforming as to frontage, having 31.51 feet of
frontage on Kite Hill Lane (s/k/a Sunset Hill Avenue) where minimum required
frontage is fifty (50) feet.
4. The premises are improved with a 510 square foot dwelling, having an existing
ground cover ratio of 28.5% where a maximum of 50% is allowed. The structure,
said to pre -exist the local adoption of the zoning by -law in 1972, is pre- existing
nonconforming as to side yard setbacks, being sited as close as 1.3 feet from the
westerly side yard lot line, three (3) feet from the easterly side yard lot line, and
2.8 feet from the northerly rear yard lot line, where five (5) foot side and rear yard
setbacks are required.

The proposed alterations to the dwelling consist of raising the structure, removing
the existing foundation and an access to the crawl space, installing a full
basement, lowering the structure back down onto a new poured concrete
foundation, and adding three window wells. The structure, as so altered, will not
be any closer to the side or rear yard lot lines than the existing structure.
6. Therefore, because the proposed alterations to the dwelling will not result in an
increase to the pre- existing non - conforming side and rear yard setback intrusions,
and will not create any new nonconformities, the Zoning Administrator finds that
the proposed work will not increase the pre- existing nonconforming nature of the
Locus.

The appellants (McGrath) are the owners of the land and buildings
situated at 12 Cliff Road, Assessor's Parcel 42.4.4 -62, being the
land shown upon Land Court Plan 40903 -A, which directly abuts
locus, by virtue of Certificate of Title No. 25710 at the Registry
District of the Land Court for Nantucket County. The appellants
(Dillard) are the owner of the land and buildings situated at 86
Center Street, Assessor's Parcel 42.4.4 -25, shown upon Plan Book
20, Page 121 at the Nantucket Registry of Deeds. The appellants
are aggrieved by the decision of the Zoning Administrator in File
No. ZA15 -15, filed with the Town Clerk on August 10, 2015, and
bring this proceeding pursuant to Nantucket Zoning By -law § 139 -31
and M.G.L., c. 40A, § 8 in order to appeal therefrom.
The work proposed by the owners of locus involves alterations to a
structure upon a nonconforming, undersized lot which is
nonconforming as to side and rear yard setbacks. The proposed work
will involve the construction of a new foundation under the
nonconforming structure, and upward expansion of the structure,
within the required 5 -foot side yard setback abutting the
appellants' property. It is the opinion of the appellants'
engineer and a consulting excavating contractor that the proposed
work is likely to cause damage to the appellants' lot and the
structures thereon. The proposed work includes the construction of
a new window well to be used for exit purposes, within the setback
area, and thus is a further expansion into the setback area. Under
M.G.L., c. 40A, § 6, the alteration of a nonconforming single or
two - family residential structure requires a finding by the special
permit granting authority that the proposed alterations, if they
increase the existing nonconformity (as is the case here, where the
volume of the structure within the nonconforming setback area will
be increased) , will not be substantially more detrimental to the
neighborhood than the existing nonconformi ties. Accordingly, the
proposed alterations to the structure upon locus will be
substantially more detrimental to the neighborhood, and the
decision by the Zoning Administrator makes no finding as to the
existence or nonexistence of any such detriment. Another aspect in
which the proposed work would be substantially more detrimental to
the neighborhood is the inadequate space upon locus for the
necessary construction vehicles to park; Kite Hill Lane, an
easement which is a portion of the land known as 5 Kite Hill Lane,
is a narrow driveway not wide enough for two cars to pass, and
affords no parking for locus.
Furthermore, the existing structure has previously been altered by
virtue of a Special Permit issued by the Board of Appeals in File
No. 107 -92, and any further alterations of the structure should
require a modification to that Special Permit.
Accordingly, the decision of the Zoning Administrator should be
overturned, and the Board of Appeals should make a determination
that the owners' proposed project would require a finding under c.

40A, § 6, which under the Nantucket Zoning By -law requires a
