appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law Section 139- 33.A(1)(b) that the
proposed alteration, extension, and structural change to the pre- existing, nonconforming
dwelling on the pre- existing, nonconforming lot will not increase the nonconforming
nature of the locus, and will not create any new nonconformities.
2. The Applicant proposes to alter and extend the pre- existing, nonconforming dwelling by
constructing a new shed dormer within the existing footprint on the south elevation.
Applicant further proposes to build an addition consisting of a pergola on the east
elevation of the dwelling which will be sited as close as 1.7 feet from the southerly rear
yard lot line. The alterations have been granted approval by the Nantucket Historic
District Commission by virtue of Certificate of Appropriateness No. 62661, as the same
may be modified and amended from time to time.
3. The Locus contains approximately 5,339 square feet in the Sconset Old Historic district
where minimum lot area is 5,000 square feet. The lot is pre- existing nonconforming as to
frontage, having approximately 19.4 feet of frontage on Elbow Lane where fifty (50) feet
of frontage are required. The 807 square foot two story dwelling on the Locus is pre-
existing, nonconforming as to side yard setback in various locations. At its closest point
on the northwest corner, the structure is sited approximately 1.3 feet from the lot line
where a five (5) foot side yard setback is required. The dwelling is also pre- existing
nonconforming as to rear yard setback in various locations, being as close as 0.2 feet
from the southerly rear lot line, where a five (5) foot rear yard setback is required.
4. Based upon the site plan entitled, "Proposed Conditions Plan of Land in Nantucket,
Mass. ", prepared by Island Surveyors LLC, dated July 14, 2015, a reduced copy of
which is attached herewith as "Exhibit A ", the Zoning Administrator finds that the
proposed work will not increase the nonconforming nature of the lot or the structure, and

will not create any new nonconformities and hereby issues the permit as requested. This
approval is subject to the following condition:
a. No exterior construction or hardscaping in connection with the project
approved herein shall occur between June 15 and Labor Day of any given year.
