Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law § 139- 33.A(3) that the various alterations to the pre- existing nonconforming locus will neither increase an existing nonconformity nor create a new nonconformity and, as such, are not substantially more detrimental to the neighborhood.. 2. The Applicant is proposing to alter the preexisting nonconforming lot located at 154 Surfside Road and shown as Lot 1 in Book of Plans 18, Page 70 recorded at the Nantucket Registry of Deeds ( "Locus "). The Locus is a preexisting nonconforming lot of record, having a lot area of 12,505 square feet in a zoning district which requires a minimum lot area of 20,000 square feet. 3. The Applicant is proposing to alter the Locus by merging Parcel "K" shown on Plan 2014 -55 and simultaneously carving out "New Lot `A "' as shown on the plan entitled, "Plan of Land in Nantucket, Mass. ", prepared for KKPC, LLC, by Bracken Engineering, Inc., dated May 1, 2015 (the "Proposed Plan "), a copy of which is attached herewith as Exhibit "A ". Applicant plans to convey New Lot "A" to the property located to the south of Locus, 8 Nonantum Avenue, so that 8 Nonantum Avenue may gain enough lot area to install a septic system. Despite the proposed conveyance of 834 square feet to the southern abutter, the end result is an increase in lot area. More specifically, the lot area of the Locus will increase from 12,505 square feet to 13,671 square feet in a zoning district that requires a minimum lot area of 20,000 square feet. 4. Based on the Proposed Plan, attached hereto as "Exhibit A ", the Zoning Administrator finds that the proposed alterations will not increase an existing or create a new nonconformity on the Locus. The proposed alterations will increase the lot area of the Locus from 12,505 square feet to 13,671 square feet, creating a more conforming lot under the zoning regulations as they apply to the R -20 district. Therefore, the proposed alterations will not be substantially more detrimental to the neighborhood.
