1. Upon review of the application submitted by the Applicant for the above -
referenced property, it was determined by the Zoning Administrator that pursuant
to Nantucket Zoning Bylaw Section 139- 33.A(1)(b), the proposed alteration and
addition to the structure does not increase the nonconforming nature of the
structure or the locus.
2. The Applicant is proposing to alter the existing structure (dwelling) by building
an addition to this approximately 882 square foot cottage known as "Reef Point ",
Unit 7 of seven units in Crow's Nest Cottages Condominium. The alterations
consist of an extension on the north side of the cottage. The total additional
ground cover for this unit will be approximately sixty (60) square feet, bringing
the dwelling's entire ground cover to approximately 942 square feet. The existing
total ground cover of the seven (7) cottages is approximately 6,605 square feet
where 27,547 square feet of ground cover is allowed. Therefore, the proposed
addition, sited within the buildable portion of the Property, will increase the
ground cover of the entire lot from approximately 7.2% to approximately 7.3% in
a zoning district where a maximum 30% ground cover is allowed. The total lot
area is 91,823 square feet in a district that requires a minimum lot area of 5,000
square feet.
3. While the structure is pre- existing nonconforming as to side -yard setbacks, being
sited as close as 4.8 feet from the southerly side yard lot line where a five (5) foot
setback is required, the addition will be built on the north side of the dwelling.
Therefore, the addition will not create any new non - conformities to either the
structure or the lot.
4. The Locus is pre- existing non - conforming with respect to setbacks, with the
subject unit sited within the required five (5) foot side yard setback and one of the
other units (Unit 1, known as "Grover ") sited within the required ten (10) foot
front yard setback, and with respect to the siting of seven structures on a single
lot where a maximum of two are allowed pursuant to 139- 7.B(1). Similar relief
has been granted to other condominium units in the past. Applicant has been
granted approvals from the Historic District Commission by virtue of Certificate
Pa
of Appropriateness No. 62885 and the Conservation Commission by virtue of
Order of Conditions recorded with the Nantucket Registry of Deeds as Document
147084.
5. Therefore, because the proposed addition and alterations would not be
substantially more detrimental to the neighborhood than the existing non-
conforming multiple cottages and will not result in any new non - conformities as
shown on the site plan entitled, "Site Plan For Zoning Administrator Decision in
Nantucket, Ma.," dated January 8, 2015, prepared by Michael Connolly &
Associates, Inc., a reduced copy of which is attached hereto and marked as
"Exhibit A ", the Zoning Administrator finds that the proposed work will not
increase the nonconforming nature of the structure or of the Locus.
