The Applicant proposes to alter the pre- existing nonconforming structure within the existing footprint. The portion of the structure to be altered is sited within the side and rear yard setbacks. The work consists of removal and replacement of a set stairs and deck at the rear of the building which provide access to the second - floor dwelling unit. The reconstructed stairs and deck will be in substantially the same footprint as the existing stairs and deck. Therefore, the alteration will be no closer to the rear or side yard lot lines than the existing structure. The proposed alterations were granted Historic District Commission approval in 2005 for a "Like- Kind" replacement. No other changes to the structure, use, or footprint are proposed at this time. 3. The Locus, as shown on plan entitled, "Mortgage Plot Plan in Nantucket, Massachusetts ", dated January 7, 1997, prepared by Charles W. Hart & Associates, Inc. and attached herewith as "Exhibit A ", is an undersized lot of record, having a lot area of approximately 1,624 square feet in the Village Neighborhood (VN) zoning district which requires a minimum lot size of 10,000 square feet. (The property was rezoned from Sconset Old Historic to Village Neighborhood by virtue of passage of Article 52 at the 2012 Annual Town Meeting.) 4. The lot contains a pre- existing nonconforming structure with an existing ground cover ratio of 68% where a maximum of 30% is allowed. The 1,096 square foot mixed -use structure is pre- existing nonconforming as to all setbacks, being sited as close as 0.2 feet from the westerly front yard lot line, abutting Main Street, as close as 2.1 from the northerly side yard lot line, 2.6 feet from the southerly side yard lot line, and .4 feet from the southerly rear yard lot line where ten (10) foot front, side and rear yard setbacks are required. The structure and its use are said to pre -exist the local adoption of the zoning by -law in 1972. The proposed 2 alterations will not increase the ground cover or the front, side or rear yard setback intrusions. 5. Therefore, because the proposed alterations to the structure will not result in an increase to the pre- existing non - conforming ground cover or setbacks, the Zoning Administrator finds that the proposed work will not increase the pre- existing nonconforming nature of the Locus.
