1. Upon review of the application submitted by the Applicant for the above -
referenced property, it was determined by the Zoning Administrator, pursuant to
Nantucket Zoning Bylaw Section 139- 33.A(1)(b), that the proposed alteration,
extension, and structural change to the pre- existing non - conforming structure does
not increase its non - conforming nature.
2. The Applicant owns Unit 6, one of eight condominium units in the Monomoy
Village Condominium off of Milestone Road. The applicant's condominium,
known as "Monomoy ", contains approximately 840 square feet and is located in
the southeasterly corner of the lot. The structure (dwelling) is pre - existing
nonconforming as to setbacks, being sited as close as 7.8 feet from the easterly
side yard lot line and as close as 13.2 feet from the southerly front yard lot line in
a zoning district which requires a minimum ten (10) foot side yard setback and
minimum twenty (20) foot front yard setback.
3. Applicant is proposing alterations to the dwelling which consist of relocating a
door and steps from the south (right) elevation to the east (rear) elevation. The
existing steps are sited 13.2 feet from the southerly front yard lot line. The
relocated steps will be sited 7.8 feet from the easterly side yard lot line and 18.2
feet from the southerly front yard lot line. As such, the relocated steps will be
sited within the required twenty (20) foot front yard setback and ten (10) foot side
yard setback but no closer than the existing setback encroachments of the
structure, as shown on the site plan entitled "ZBA Exhibit Plan"; "Monomoy
Village Condominium ", prepared by Paul J. Santos, PLS, dated April 8, 2014,
revised on September 24, 2014, attached herewith as "Exhibit A ". There will be
no additional ground cover for this unit. The proposed alteration benefits from
Historic District Commission approval by virtue of Certificate of Appropriateness
No. 62436.
4. The Locus is pre- existing non - conforming with respect to use due to the siting of
eight structures on a single lot where a maximum of two are allowed pursuant to
139- 7.13(1). In Board of Appeals Decision No. 056 -86, the locus was granted

Special Permit relief to extend and alter the pre- existing nonconforming use and
structures, validating the year -round condominium ownership of the eight
cottages for single - family residential use.
5. The locus is also pre- existing non - conforming with respect to ground cover. The
existing total ground cover of the eight (8) cottages is approximately 19.7% in a
zoning district with a maximum allowance of 10 %. The total lot area is 40,000
square feet in a district that requires a minimum lot area of 20,000 square feet.
6. Therefore, because the proposed alterations will not result in an increase to the
pre- existing non - conforming front and side yard setbacks of the structure, known
as Unit 6 and called "Monomoy ", the Zoning Administrator finds that the
proposed work will not increase the pre- existing nonconforming nature of the
structure or the Locus.
