Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law Section 139 - 33.A(1)(b) that the proposed alteration, extension, and structural change to the pre- existing non - conforming structure does not increase its non - conforming nature. 2. The Applicant proposes to alter the pre- existing nonconforming structure by building a deck addition to be sited within the required ten (10) foot front yard setback but no closer than the existing encroachment of the outbuilding which is sited 3.9 feet from the westerly front yard lot line at its closest point. The alteration consists of construction of a deck, measuring approximately six (6) feet in width and 16.3 feet in length, to be sited no closer than five (5) feet from the westerly front yard lot line abutting Lincoln Street. The locus was recently granted relief by the Zoning Board of Appeals in File No. 45 -14, recorded at Book 1462, Page 129 on file at the Nantucket County Registry of Deeds. The initial relief allowed for the demolition, reconstruction, and expansion of the pre- existing nonconforming accessory building substantially in the same location but did not specifically address the addition of the deck. The proposed alterations benefit from Historic District Commission approval by virtue of Certificate of Appropriateness No. 62375. 3. The Locus is a pre - existing nonconforming undersized lot of record, having a lot area of 4,740 square feet in the SR -1 zoning district which requires a minimum lot size of 5,000 square feet, and having double - frontage on Lincoln Street to the west and West Sankaty Road to the east. Due to the double frontage, the required rear yard setback distance for this lot is ten (10) feet. Pursuant to Bylaw Section 139- 16.C(3), structures on a lot in the SR -1 zoning district abutting two or more streets or ways, whether constructed or not, must maintain the minimum ten (10) foot setback from each street or way. 4. The lot contains two pre- existing nonconforming structures. The dwelling structure is pre- existing nonconforming as to setbacks, being sited nine (9) feet from. the rear lot line, abutting W. Sankaty Road, where a ten (10) foot setback is required. The proposed alterations to the dwelling will take place entirely outside of the setbacks. The outbuilding is pre- existing nonconforming as to setbacks, being sited 1.9 feet from the northerly side yard lot line at its closest point, where a five (5) foot side yard setback is required, and 3.9 feet from the front yard lot line, abutting Lincoln Street, where a ten (10) foot front yard setback is required. The two structures on the lot are said to pre -exist the adoption of the zoning by- law. The proposed alterations will not increase the side, front or rear yard setback intrusions and will be located entirely within the buildable area of the lot. 5.
