1. At a public hearing of the Nantucket Zoning Board of Appeals, opened on November 13,
2014 and closed on December 11, 2014 at 4 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following decision on the application of DON ALLEN AUTO SERVICE,
INC., of 24 Polpis Road, Nantucket, MA 02554, File No. 061 -14:
2. Applicant is requesting Modification of prior Special Permit relief, granted in three
decisions, to allow for exterior display of sales vehicles as shown on a revised "Exhibit A ".
Special Permit File No. 105 -06, modified by Special Permit File No. 03 -12, granted relief for
the alteration and expansion of a pre- existing nonconforming commercial use to allow for the
inspection, detailing, and sales of vehicles. The most recent modification, File No. 38 -13,
granted relief to reduce the open area requirements and to increase the driveway width.
3. Our Decision is based upon the application and accompanying materials and
representations and testimony received at the public hearing. At its hearing on November 10,
2014, the Planning Board strongly recommended approving this request. They specifically noted
that the premises have undergone major improvements since being converted into the current
operation and use. There was no opposition, written or oral, to the application.
4. Eric Evens represented the Applicant at both hearings. Mr. Evens explained to the Board
that the applicant is requesting a modification of the approved site plan in order to allow a
portion of the paved parking area to be used for the display of sales vehicles upon the premises at
10 Polpis Road. The Locus, improved with a 4,750 square foot garage and office building,
benefits from prior Special Permit relief for commercial uses in connection with the operation of
Don Allen Auto Service, Inc. Specifically, the current commercial uses allowed upon the
premises include washing and detailing of motor vehicles, the operation of a Massachusetts
State Inspection Station, the sales of motor vehicles, as well as parking ancillary to those uses.
5. At the public hearing on November 13, 2014, the Board examined the proposed
configuration of display, parking, and inspection lane areas. They recommended that the
applicant return to the surveyor to seek an alternative layout of these areas which would maintain
efficient traffic flow while retaining the required number of parking spaces. They specifically
suggested that the applicant use one of the three inspection lanes for parking, thereby freeing up

the three spaces at the front of the lot (southeast corner) as an ideal display area. At the hearing
on December 11, 2014, the applicant submitted a new plan, entitled "Proposed Conditions Plan,
#10 Polpis Road, in Nantucket, Massachusetts ", dated December 4, 2014, prepared by Earle &
Sullivan, Inc. and attached herewith as "Exhibit A ". Upon examination, the sitting members of
the Board found this plan to be preferable to the initial proposal.
6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals voted
to APPROVE the requested modification of prior relief based on the following findings:
a. That exterior display of sales vehicles may be allowed upon the
premises as a use ancillary to the operation of Don Allen Auto Service,
Inc.;
b. That the modification to the previously approved site plan is consistent
with the intent of the previous decision.
The Board's vote was also subject to the following conditions:
a. That the parking and display area shall be in substantial conformity
with the 2014 Site Plan, attached herewith as "Exhibit A ";
b. Except as herein modified, the relief granted by this Board in prior
Decisions referenced above remains in full force and effect.
