The applicants propose to demolish the single - family dwelling which
constitutes Unit 1 of the Squam Head Condominium, and to construct
a new single - family dwelling to become a replacement Unit 1,
without surrendering or abandoning the right to preserve the
condominium status of locus, which was derived from its having been
improved with two single- family dwellings which existed before the
adoption of the Nantucket Zoning By -law in 1972. See Board of
Appeals decisions 061 -06, which confirmed the right of the owner of
Unit 2 to demolish and rebuild Unit 2 without loss of condominium
status, and 088 -07, which authorized the reconfiguration of the lot
line of locus after an exchange of land with abutting property.
Accordingly, the applicants request relief by Special Permit under
Nantucket Zoning By -law §139 -33.A in order to authorize the
alteration of the locus by demolition of the existing Unit 1
dwelling and its replacement with a new dwelling, of be designated
as Unit 1, and conforming the validity of the condominium status of
locus. All structures upon locus will conform with all dimensional
requirements under the Zoning By -law.

1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday,
October 9, 2014, at 12:30 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board
made the following decision on the application of E. GARRETT BEWKES, III, and JANE E.
BEWKES, c/o Reade, Gullicksen, Hanley, Gifford & Cohen, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 054 -14:
2. The subject property is a condominium known as the Squam Head Condominium,
consisting of two units, each of which is a free - standing single - family dwelling. Unit 1 has been
purchased by the applicants since the filing of the application; Unit 2 is owned by Far Greater
Folly, LLC. The applicant is requesting Special Permit relief pursuant to Zoning Bylaw Section
139- 33.A(1) to allow the alteration of Unit 1 by demolition and reconstruction of a replacement
structure without the loss of condominium status. The proposed work will meet all dimensional
requirements of the Bylaw. The Locus is situated at 73A & 73B Squam Road, also known as
Units 1 and 2 of Squam Head Condominium, is shown on Nantucket Tax Assessor's Map 13 as
Parcels 11.1 and 11.2, and as Lots 6A and 3B on Plan No. 2008 -82. Evidence of owner's title is
recorded at Book 1449 Page 201 and Book 1203 Page 26 on file at the Nantucket County
Registry of Deeds. The site is zoned Limited Use General 1 (LUG -1).
3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern was presented. There was one
letter in opposition from abutters; no support nor opposition was presented at the public hearing
except for the presentation by the applicants' representatives.
4. Locus contained two dwellings pre - existing the 1972 adoption of the Nantucket
Zoning Bylaw. The former owners submitted locus to the condominium regime in 2003, on the
basis that (notwithstanding the requirement that the primary and secondary dwelling on each lot
in the LUG -1 district be in common ownership) the pre -1972 status of each dwelling constituted
a pre- existing nonconforming condition entitling the dwellings to be conveyed separately as
condominium units. In Board of Appeals Decision No. 061 -06, the Board granted Special
Permit relief to the owner of Unit 2, confirming the grandfathered status of locus and authorizing
the demolition of the Unit 2 dwelling and construction of a new dwelling in its place, without
loss of the legitimacy of condominium status. We are informed that this demolition and
reconstruction of Unit 2 has taken place. The applicants now, similarly, request the same relief
with respect to Unit 1.
5. In the view of the required supermajority of the Board, the relief granted in File No.
061 -06 has established the legitimacy of the condominium regime upon locus and the method for
replacement of the dwellings upon locus while protecting the condominium status. Accordingly,
by a majority vote of FOUR in favor and ONE (Poor) opposed, the Board made the finding that
the alteration of Unit 1 by demolition and reconstruction as proposed by the applicants, creating
no new zoning nonconformities and specifically complying with all dimensional requirements,
would not be substantially more detrimental to the neighborhood than the pre- existing
nonconformity, and voted to grant the requested relief by Special Permit pursuant to Zoning
Bylaw Section 139- 33.A(1).
