1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(1)(b) that the proposed alteration and structural change to the pre - existing,
non - conforming structure does not increase its nonconforming nature.
2. The Applicant proposes to alter the main dwelling by constructing a set of steps
for a ground floor deck on the northeast corner of the structure. In prior Special
Permit, the proposed location of two sets of deck steps was on the northwest
corner of the reconstructed main dwelling. The modified proposed siting of the
steps is on the northeast corner, approximately 8.8 feet from the easterly lot line,
and will be no closer to the side yard lot line than the existing structure, as shown
on plan entitled "Proposed Site Plan Modifications in Nantucket, Massachusetts ",
prepared by Bracken Engineering, Inc., dated July 17, 2014, a reduced copy of
which is attached herewith as "Exhibit A ".
3. The locus is pre- existing non - conforming as to lot size, containing 12,188 square
feet in the Village Residential zoning district which requires a minimum lot area
of 20,000 square feet; and as to frontage, having approximately fifty (50) feet of
frontage where one hundred (100) feet is required. The structures on the locus, a
1,405 square foot dwelling and a 240 square foot garage with an attached 18
square foot utility shed, are nonconforming as to side yard setbacks, being sited
approximately 4.3 feet from the westerly side yard lot line, and 8.8 feet from the
easterly side yard lot line where ten (10) foot side yard setbacks are required.
4. Applicant benefits from prior Special Permits (Decision No. 63 -12, as modified
by Decision No. 39 -14) which granted relief allowing the removal, relocation,
and reconstruction of all or a portion of the two pre - existing nonconforming
structures.

5. Therefore, because the modified siting of the deck stairs will be no closer to the
side yard lot line than the existing structure, the Zoning Administrator finds that
the proposed work will not increase the pre- existing nonconforming nature of the
structure or the Locus.
