At a Public Hearing of the ZONING BOARD OF APPEALS held at
1:00 P.M., Friday, March 10, 1995, in the Selectmen's Meeting Room
in the Town and County Building, Broad Street, Nantucket,
Massachusetts, on the Application of Patricia W. Los &, of P.O. Box
494, Siasconset, Nantucket, MA 02564, Board of Appeals File No.
014 -95, the Board made the following decision.
1. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning
By -Law 139 -33A in order to be allowed to alter and extend a said
to be pre- existing, nonconforming garage structure by constructing
a 64 square foot, plus or minus, addition to be used as a workroom,
on the easterly side of the structure, and a 34 square foot, plus
or minus, addition on the southerly side to enable a vehicle to
park in that portion of the garage and increase the ground cover
ratio from 37.31 plus or minus, or 1160.6 square feet, plus or
minus, to 40.4 %, plus or minus, or 1260 square feet, plus or minus.
The structure is nonconforming as to rear yard setback, having a
setback of 1.4 plus or minus feet from the rear lot line at its
closest point; as to side yard setback, have a setback of 2.2 plus
or minus feet from the westerly lot line at its closest point, in
a district that requires a rear and side yard setback of five feet;
as to ground cover, having a current ground cover ratio of 37.3 %���
pl minus in a district that has as maximum ground cover ratio`
of 30% for undersized lots ; and as to lot size, having 3120 plus
or us square feet of area in a district that requires a minimum
lot size of 5,000 square feet. The easterly side addition will

continue the nonconforming 1.4 plus or minus foot setback distance
along the rear lot line without coming any closer to that lot line
and the southerly addition will continue the nonconforming 2.2 plus
or minus foot setback distance along the side yard lot line without
coming any closer to that lot line.

The premises is located at 11 Pochick Street, Siasconset,
Assessor's Nap 73.3.1, Parcel 26, as shown in Registry Plan Book
3, Page 52, Lot 12. Property is zoned R /OH.
2. The Board's decision is based upon the Application and
materials submitted therewith, and testimony and representations
made at the hearing and six letters in support on file. The
Planning Board made no recommendation.
3. Applicant's attorney represented that both the lot and the
buildings thereon pre -date zoning. The applicant would like to put
a small addition on the rear of the garage to be used as workshop
and a small addition to the front of the garage. Applicant
represented that the rear addition of e' plus or minus by 8' plus
or minus along the rear portion of the easterly side of the one bay
garage is to be used as a workshop, and a 1114" plus or minus by
a 3' plus or minus addition onto the front of the garage shall
allow the continued use of a portion of the structure as a one car
garage. The new ground cover, with both additions, will increase
from 1160.6 plus or minus square feet or 37.3% to 1260 plus or
minus square feet making a total ground cover of 40.4% in a
district that allows 301 maxim,im ground cover ratio for undersized
lots. The rear addition will :ontinue the non - conforming rear lot
line setback of 1.4 feet for a distance of eight (a) feet but will l
not come any closer to the rear lot line. The southerly addition
will continue the non - conforming side lot line setback of 2.2 feet
for a distance of three (3) feet but will not come any closer to
the side yard lot line. The additions will be one story and will
not be used for human habitation.

4. The Board finds that the requested use will be in harmony ;
with the spirit and intent of the By -Law and will not have an
adverse impact on the neighborhood.
5. Accordingly, the Board, by vote of 4 -1 (Williams,
Hourihan, Waine, and Sevrens in favor, Balas opp ^sed), grants the
requested Special Permit under Section 139 -33A of the Zoning
By -Lav under the following conditions:
i
(a) That the additions be one story and be constructed
in the location and of the size as shown on building
location plan prepared by Blackwell 4 Associates,
Inc., dated August 1, 1994 (revised February 22,
1995), a copy of which is attached hereto as
Exhibit "A ".
(b) That said additions be constructed in substantial
conformance with an HDC certificate of
Appropriateness.

garage and a workshop ". Applicant further seeks, to the extent necessary, Special Permit
relief pursuant to Section 139 -33.A to allow a change of use of the existing garage
structure to a dwelling. Applicant proposes to construct a 111 square foot addition
connecting the existing dwelling to the existing garage /workshop. The Locus is situated
at 11 Pochick Street, Siasconset, is shown on Nantucket Assessor's Map 73.3.1 as Parcel
26, and as Lot 12 on Plan Book 3, Page 52. Evidence of owner's title is recorded at Book
1280, Page 16 on file at the Nantucket County Registry of Deeds. The property is zoned
Sconset Old Historic (SOH).
3. Our Decision is based upon the application and accompanying materials and
representations and testimony received at the public hearing. There was no Planning
Board recommendation on the basis that no matters of planning concern were presented.
There was opposition and support, both written and oral, to the application.
4. The Applicant, represented by George D. Williams, proposes to alter the pre-
existing nonconforming structure by building an addition to be sited outside the setbacks.
The alteration consists of a 111 square foot addition, which will contain a full bathroom
and will connect the 950 square foot main dwelling to the 300 square foot garage
structure. The rear portion of the garage to be annexed to the dwelling will be used as an
office with a half -bath.
While the southerly portions of both the main dwelling and the garage encroach upon the
five (5) foot rear setback, the addition will be sited no closer to the lot line than the
southern facades of the structures to be joined together by the addition. The additional
ground cover will result in an overall ground cover of 1,361 square feet, increasing the
ground cover of the entire lot from approximately 40.1 % to approximately 43.7 % in a
zoning district where a maximum 50% ground cover ratio is allowed.
5. The dwelling and garage structures are pre- existing nonconforming as to side and
rear yard setbacks. The dwelling is sited as close as 4.3 feet from the easterly side yard
lot line and 2.3 feet from the southerly rear yard lot line. The garage is sited as close as
2.2 feet from the westerly side yard lot line and 1.4 feet from the southerly rear yard lot
line in the SOH zoning district where minimum five (5) foot side and rear yard setbacks
are required. The locus, shown on the plan entitled "Building Location Plan of Land in
Nantucket, Ma. ", prepared by Blackwell and Associates, Inc., dated April 7, 2011, a
reduced copy of which is attached herewith as "Exhibit A ", is pre- existing
nonconforming with respect to lot size, having an area of approximately 3,120 square feet
in a zoning district with a minimum requirement of 5,000 square feet. The two structures
on the lot are said to pre -exist the adoption of the zoning by -law. The proposed alteration
will not increase the side or rear yard setback intrusion and will be located entirely within
the buildable area of the lot.
The garage /workshop is subject to the provisions of a Special Permit granted to a prior
owner. Decision No. 014 -95 allowed the expansion of the garage to accommodate a
workshop and one car. The relief granted was subject to a condition which stated, "There
shall be no living space for human habitation and the structure shall be used as a garage
and a workshop." The proposed addition will annex the dwelling to the garage /workshop.
Applicant proposes to use this new wing of the dwelling as an office with half -bath.
6. An abutter to the locus spoke at the hearing. The concerns, which were similarly
expressed in written opposition by other abutters, pertained to the change of use of the
garage /workshop. The abutters note that the property is currently for sale and that, while
the current application proposes an office with half -bath, a future owner could potentially
convert this wing of the dwelling into a living space for human habitation, contrary to the
aforementioned restriction. The consensus of the abutters was to maintain the restriction
on human habitation. One direct abutter wrote, "The apparent reason for the condition
was to minimize impact of the structure on the surrounding owners, given the small lots
and the close proximity of the houses in the area. Presumably the purpose of the
condition included keeping disturbing noises to a minimum."
7. Therefore, after a discussion with the Applicant and due consideration for the
concerns expressed by the abutters, the BOARD made the finding that the proposed
alterations to the pre- existing nonconforming structures do not increase the
nonconforming nature as to setback distance, are in harmony with the general purpose
and intent of the Zoning Bylaw, and shall not be substantially more detrimental to the
neighborhood, provided that the portion of the garage /workshop wing of the main
dwelling shall not be used for any other purpose than the proposed use as an office with
half -bath.
8. Accordingly, by a UNANIMOUS vote, the Board voted to grant the requested
Modification of prior Special Permit to allow the construction a 111 square foot addition
connecting the pre - existing nonconforming dwelling with the pre- existing nonconforming
garage /workshop subject to the following conditions:
a) The proposed alterations shall be constructed in substantial
compliance with the proposed site plan entitled, "HDC
Submission: Proposed Addition ", prepared by MWP Residential
Design., dated June 16, 2014, a reduced copy of which is attached
herewith as "Exhibit B ";
b) As to the portion of the garage /workshop which the Applicant
proposes to annex to the main dwelling, via the connecting bathroom
addition, there shall be no living space for human habitation and the
annexed garage wing shall be used as an office with half -bath. Any
change to said use of this portion of the structure shall not occur
without further relief from this Board.
