1. At a public hearing of the Nantucket Zoning Board of Appeals (Board) on Thursday,
September 11, 2014, at 1:00 p.m., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board
made the following decision on the application of RICHARD B. URBAN and JOCELYN S.
URBAN, of P.O. Box 840, Georgetown, Connecticut, 06829, File No. 47 -14:
2. Applicant is requesting Special Permit relief pursuant to Zoning Bylaw Section 139 -33
and to the extent necessary Variance relief pursuant to Section 139 -32 to allow the alteration and
extension of a 222 square foot pre- existing nonconforming garage structure. Applicant proposes
to raise the roof line, make fenestration changes, and install shed dormers within the setback
areas. Applicant further proposes to construct a fifteen (15) square foot storage shed addition, to
be attached to the easterly side of the subject structure, which would be sited outside the five (5)
foot side and rear yard setback areas. The proposed work would result in an upward extension of
the pre- existing nonconforming side and rear yard setbacks as well as an increase in the pre-
existing nonconforming ground cover ratio of 33.1% to 33.5% where 30% is allowed. The Locus
is an undersized lot of record situated at 51 Cliff Road, is shown on Assessor's Map 30 as Parcel
62, and on Plan Book 9, Page 6 (less portion taken for roadway). Evidence of owner's title is
recorded at Book 698, Page 67 on file at the Nantucket County Registry of Deeds. The property
is zoned Residential- 1(R -1).
3. Our decision is based upon the application and accompanying materials, representations,
and testimony received at our public hearing. There was no Planning Board recommendation on
the basis that no matters of planning concern were presented. There was no opposition, written
or oral, to the application.
4. Alisha Ranney of Botticelli & Pohl, PC represented the Applicant and explained the
proposed work. The Applicant is seeking to renovate and expand a garage structure, which is
pre- existing nonconforming as to setbacks, in order to convert this accessory structure into a
painting studio. The proposed alterations, approved by the Historic District Commission, consist
of fenestration and roofline changes, the addition of dormers, and the construction of a small
shed, to be attached to the east side of the garage, which will be used for bike storage. The
addition of the fifteen (15) square foot shed will cause an increase in the pre - existing
nonconforming ground cover.
5. The Locus is pre- existing non - conforming with respect to lot size having an area of 3,905
square feet in the R -1 zoning district which requires 5,000 square feet, and with respect to
ground cover having an overall ground cover of 1,293 square feet, or a ground cover ratio of
33.1 %, where approximately 1,171 square feet, or a maximum of 30 %, is allowed. The structures
are pre- existing non - conforming with respect to required side and rear yard setbacks. Pursuant to
Bylaw Section 139 - 16.(3), a minimum ten (10) foot side yard setback shall be maintained in the
R -1 zoning district for lots that abut two or more streets or ways. The locus abuts Cabot Lane on
the northwest and Cliff Road on the south. The dwelling, not proposed to be altered under the
present application, is sited approximately .9 feet the northwesterly side yard lot line at its closest
point. The garage structure is sited approximately one (1) foot from the northwesterly side yard
lot line and four (4) feet from the northerly rear yard lot line at its closest points. The locus
benefits from a prior Special Permit relief in Zoning Board of Appeals Decision File No. 051 -02
for alterations made to the dwelling which did not result in an increase to any setback or ground
cover nonconformities.
6. Therefore, the BOARD makes a specific finding that the proposed storage shed addition
with an approximate ground cover of fifteen (15) square feet may not be allowed as it would
result in a further increase in the pre- existing nonconforming ground cover ratio from
approximately 33.1% to 33.5% in zoning district which allows a maximum ground cover ratio of
30 %. The Board determined that there is sufficient room on the premises to build the shed as a
detached Zoning Shed which would not contribute to ground cover pursuant to the definition of
Ground Cover in Bylaw Section 139 -2.A which "excludes not more than one accessory detached
shed covering an area not to exceed more than 121 square feet at grade." The BOARD made the
further finding that the remainder of the proposed alterations to the garage /painting studio will
not increase the pre- existing nonconforming setback distances, will not alter the existing
footprint, are not substantially more detrimental to the neighborhood than the pre - existing
nonconforming garage structure, and are deemed architecturally appropriate as determined by the
Nantucket Historic District Commission by virtue of Certificate of Appropriateness No. 61792.
7. Accordingly, while the sitting BOARD of the ZONING BOARD OF APPEALS voted
unanimously to deny the request for relief by Variance to allow an increase in ground cover that
would result from the construction of an attached shed, the BOARD voted by UNANIMOUS
VOTE to grant a SPECIAL PERMIT for the remainder of the relief sought by the Applicant
pursuant to Nantucket Zoning By -Law Section 139- 33.A(1)(a) allowing the alterations of the
pre- existing nonconforming garage with following conditions:
a. The alterations to the garage /painting studio shall allow for the installation of a
sink but no waste plumbing;
b. The garage /painting studio structure shall not be used for human habitation;
c. The proposed shed shall not be attached to the garage /painting studio and shall be
sited outside of the five (5) foot side and rear yard setbacks. The Zoning Shed will
be built as a detached structure that will not contribute to ground cover pursuant
