Applicants seek a Special Permit to contruct a new 1,420 square foot dwelling and 672 square foot second dwelling and attached
garage, totalling 2,092 square feet. The Property currently consists of a 33,642 + /- square foot lot in a zoning district with a
minimum required lot area of 80,000 square feet, and a ground cover ratio of 5.4 % (1,812 square feet) in a district where 4%
(1,345 or 1,500 square feet for lots of record) is the maximum ground cover ratio allowed. The existing dwelling and attached
garage on the Property were constructed prior to 1972. The Property is therefore preexisting nonconforming with respect to the
current zoning regulations in the LUG -2 Zoning District. Special Permit No. 067 -13 was previously granted to Applicants for the
demolition of the existing dwelling and attached garage, further permitting construction of a new 1,412 square foot dwelling
together with separate 400 square foot garage. The proposed increase is minimal and will increase the total ground cover by 280
square feet with a ground cover percentage of 6.2% and will not be significantly more detrminental to the neighborhood.

application materials. Enclosed is the application with supporting documentation
with respect the Premises located at 5 Heller Way. The Applicants were
previously granted a Special Permit No. 067 -13 to demolish the existing dwelling
and attached garage, totaling 1,812 square feet, and to construct a new dwelling
and detached garage, totaling 1,812 square feet. However, Applicants now
request a Special Permit under Section 139- 33(A)(4)(a) of the Nantucket Zoning
By Law to increase the total square footage of the proposed new dwelling and
detached garage to 2, 092 square feet. While the property is currently preexisting
and nonconforming with respect to ground cover and the front yard setback, the

ADDENDUM TO ZONING APPLICATION
The Applicants, Eric F. Silverman and Melanie W. Silverman (hereinafter the
"Applicants "), are the owners of 5 Heller Way, Nantucket, MA 02554, shown as Lot 8 on Land
Court Plan 36551 -B registered at the Nantucket Registry District of the Land Court and as Parcel
46 on Nantucket Town Assessor's Map 82 (the "Property "). The Applicants hereby request
Special Permit relief pursuant to Section 139 -33 (A)(4)(a) and (b) of the Nantucket Zoning By-
Law (the "By- Law "). The Property is located in the Limited Use General -2 ( "LUG -2 ") Zoning
District and is currently improved with a dwelling and attached garage. Special Permit No. 067-
13 was previously granted to Applicants for the demolition of the existing dwelling and attached
garage, further permitting construction of a new 1,412 square foot dwelling together with separate
400 square foot garage. Applicants seek now to increase the total ground cover from the permitted
1,812 square feet to 2,092 square feet, consisting of a 1,420 square foot dwelling and a 672 square
foot second dwelling with attached garage.
The existing conditions of the Property are shown on an As Built Plot Plan prepared by
Nantucket Surveyors LLC, dated July 23, 2013 (the "As Built "), a copy of which is attached as
Exhibit A. As shown on the As Built, the Property consists of a 33,642 + /- square foot lot in a
zoning district with a minimum required lot area of 80,000 square feet; has frontage in the amount
of 206.77' where 150' is required; a front yard setback of 31.4' where 35' is required; a 71.9'
easterly side yard setback and a 73.7' westerly side yard set -back where 15' is required, a rear yard
setback of 66' where 15' is required; and a ground cover ratio of 5.4 % (1,812 square feet) in a
district where 4% (1,345 or 1,500 square feet for lots of record) is the maximum ground cover
ratio allowed.
As evidenced by the Zoning Affidavit and the As Built, a copy of which is attached as
Exhibit B, the existing dwelling and attached garage on the Property were constructed prior to
1972. The Property is therefore preexisting nonconforming with respect to the current zoning
regulations in the LUG -2 Zoning District.
PROPOSED ALTERATIONS
The Applicants propose to demolish the existing dwelling and attached garage and to
construct a new 1,420 square foot dwelling together with separate 672 square foot second dwelling
with attached garage. The ground cover on the Property will increase by only 280 square feet and
the Applicants will honor the original plan to cure the existing front yard setback violation. The
property will comply will all other zoning regulations in the LUG -2 zoning district. The
Applicants have attached a Site Plan showing these proposed plans as Exhibit C, and will
supplement this application with an updated surveyed plan.
Under Section 139 -33A (4)(a) and (b) of the By -Law:
(4) Preexisting, nonconforming structures or uses may be extended or altered, provided that:
(a) No such extension or alteration shall be permitted unless there is a finding by the permit
granting authority or by the special permit granting authority designated by this chapter
that such change, extension or alteration shall not be substantially more detrimental
than the existing nonconforming use to the neighborhood; and
(b) A special permit supported by such finding is granted.
CONCLUSION
Granting the proposed Special Permit under the above referenced Section of the By Law
for the proposed work will not be substantially more detrimental to the neighborhood than the pre-
existing non - conforming structures on the Property and the previously granted Special Permit. As
noted, the ground cover will increase minimally and the front yard setback violation will be cured
as a result of the proposed work. Further, the new dwelling and garage will comply with the zoning
regulations in all other respects. The proposed plans are suitable for the Property as they are
consistent with the existing conditions on the Property and in harmony with other properties in this
area of the Island. Specifically, properties directly across the street have significantly higher
ground cover ratios. Finally, by granting the requested Special Permit, the Board would be acting
in a manner consistent with the spirit and intent of the Zoning By -Law.
The Applicants respectfully request that the Board grant the requested relief.

known and numbered as 5 Heller Wray, Nantucket, Massachusetts 02554, and shown as Lot 8 on
Land Court Plan 36551 -B filed with Certificate of Title No. 6263 at the Registry District of
Nantucket County (the "Premises ") since a time prior to July 1, 1972.
