None 1. March 27, 2014 — Approved by unanimous consent Jeff Carlson, Natural Resources Coordinator — Offered the class; 180 went through the first class. Looking to set up other classes. Have put through an additional 90 people since the initial class; all attendees have been issued licensing cards. Stated they have had positive feedback about the classes. His office wants to address getting the class offered in Spanish or have the video translated into Spanish. He said he found someone in NJ who is willing to teach a Spanish licensing class on the fertilizer regulations. Looking to short specialty classes as continuing education and create classes for people not involved in turf He is looking for members to be on a Best Management Practices review committee. Staff Ray — There are no regulations associated with this to Title 5 or the code. The lines hook the houses to the leach facility. Recommend approval. Representative Marianne Hanley, Reade, Gullicksen, Hanley, Gifford & Cohen LLP — Requesting to change the easement area on two lots. Reducing the side and rear from 10 feet to 8 feet. Need an amendment agreement signed for the public record. Discussion Cooper — Asked if the land surrounding is part of the subdivision. Hanley — Easement is located against Lot 16 which is open space. Action Motion to Approve. He will try to advertise opportunities for homeowners and the general public. The effort has been to have several designated persons in a business who me a licensed fertilizer crew member rather than trying to get every employee of every business. Explained that the licenses are issued through the Natural Resource Office, they are not photo IDs. Cooper — Asked how the retailers me accepting this. Carlson — A number of retailers have attended the classes and me happy to comply as long as it doesn't affect their business. Fertilizer producers have begun creating Nantucket blends that comply with the regulations. Weld — Asked if the licensing applies to caretakers. Carlson — If they are commercially applying fertilizer, yes it does. He has been told by those lawn -raze professionals and caretakers who have gone through the raining that they have found the information very useful. MacNab — He attended the fast seminar and found it very appropriate. He encouraged all the Board members to attend a seminar. Staff This is a technically failed septic system. Until a decision is made to go either sewer or alternative technology, the owner has opted for the ACO. The system is functioning appropriately; it is just close to groundwater. The Health department allows the holders of the ACO to carry on as long as they pay into the ACO. Representative None Discussion Clarification of how the ACO works and what happens to the money when a decision is finally made. Atherton — The Board of Selectmen (BOS) has been promised a report from the consultant which should be ready in Jere. There would then be deliberation and public hearings before the final decision is made. Motion to Approve. (made by: Weld) (seconded by: Cooper) Carried unanimously 1. Potential Regulations — Tick -Some Disease information requirements for lodging houses Sitting MmNab, Cooper, Weld, Visco, Atherton Discussion MacNab — Information about TBD dropped off at Inns tended to be tucked out of sight Would like to see a regulation requiring educational material "must display prominently". Ray — The island has grown in its knowledge of TBDs; there me a number of handouts, the video, a discussion about TBD, the TBD workgroup. He leans towards holding off on a regulatory approach to see if he can get more cooperation from the lodging businesses. Weld — About five years ago, the Nantucket Community Association published a pamphlet for boarding houses and visitors services which got tucked away rather than being disseminated. Since then there has been more awareness about TBDs through the press. Supports Mr. Ray. Jack Gardner — Several years ago there was folder that a tourist could take home to his /her doctor about Lyme disease. Thinks it is time for something like that again. Discussion about getting handouts /information into the hands of the visitors through the SSA, Hy -line, airport, lodging association, rental agencies, and Chamber of Commerce. Consensus is that the board is reluctant to move forward with regulations at this time. MacNab — Asked for a report next month from Mr. Ray on the responses of the various groups he talked to about dissemination of TBD printed information. Formation of Tick -Bome Disease Workgroup Sitting MacNab, Cooper, Weld, Visco, Atherton Discussion Weld — Don't think the work required to come up with a comprehensive plan can happen at this table. The workgroup would do the work and then bring forward recommendations. Discussion about possible members. MacNab — Suggested meeting with Ms Weld to discuss this. 3. Update on Tick -Bome Disease video Sitting MacNab, Cooper, Weld, Visco, Atherton Discussion MacNab — The video is progressing; an outline is being worked on as well as people interviewed for the video. The next step is a script with shooting to start in June. When a script comes in, he will make it available to the Board members. 4. Summer Intern Responsibilities /Nantucket Cottage Hospital (NCH) contract renewal Sitting MacNab, Cooper, Weld, Visco, Atherton Discussion Ray — Have a recommendation for a pre -med student with island ties. Asked if the Board would like the protocol information repeated from last year. MacNab — Feels there can always be improvements to the gathering of information and more accurate numbers would be helpful. Discussion about the paying the intern. Ray — There have been problems with the funding but there should be some available. Will know more at the beginning of FY2015. Discussion about why the BOH doesn't have its own budget /line item under Planning and Land Use Services. 5. Skin cancer symposium Sitting MacNab, Cooper, Weld, Visco, Atherton Discussion MacNab — This was in the budget for last year and didn't happen. Weld — The BOH was partnering with NCH and it fell apart for various reasons. Asked if the Board is interested in trying to do this again this year. Discussion about the cost for doing this sort of symposium and scheduling the participants. Weld — If this Board is determined to go forward, this Board would have to stay on top of organizing the symposium. Explained the TBD symposium was very successful. MacNab — This is a good topic for a summer symposium, about August. Suggested contacting physicians for dates. Atherton — Money is not an issue, it can be found. Ms Weld will spearhead organizing this. Page 3 of 4 Minutes for April 17, 2014, adopted May 22 Staff Sent the draft to the board. In the past 2%2 to 3 weeks, the press has cited Nantucket as the leader in biodegradable packaging. Unfortunately, one notices that in practice that might not be entirely true. The present bylaw has no teeth at this time as the enforcement language was removed. The larger stores have maintained no Styrofoam or plastic bags; however, that is not happening in take -out services. The Town needs to live up to its reputation. In that regard, he has solicited several companies and received samples that are completely compostable. This is something that needs to be used everywhere on the island. There is an outlet on island for these products. The Board has to determine whether or not the regulation will be enforced and who will enforce it. It can be a by -law or a regulation from the Health Department or a regulation with the Department of Public Works enforced by the Health Department. Discussion Cooper — Asked about the price. Ray — They are a bit more expensive. But Nantucket is looked at as a model community in use of biodegradable materials. Asking for a vote to proceed with this. Atherton — There will be a push back if there is an increase in costs from using these items. Ray — This Board has to look at the regulation and decide what venue is most appropriate for it. It would be enforced by the BOH. Businesses have already ordered their summer stock. This needs to be done about next February for the 2015 season. Atherton — Even if this stuff costs a little more, it will cost less to dispose of these items at the landfill. MacNab — Told Mr. Ray to continue doing his research. 1. Mr. Ray will unveil a tick- testing program to the BOS next Wednesday. Nantucket was offered the opportunity to test this. It tests a tick for TBD rather than the person. A person who finds a tick can send it to the lab and have results in 48 hours. It could help identify where the diseased ticks are congregating and what diseases they are carrying. The program is free. The application for this will be on the website. Only 100 tests ate allocated per community this year. Thinks this is worthwhile. 2. Health Department is already receiving complaints about the housing issues. Perceives his staff will be very busy with reports of overcrowding this summer. Explained the inspection and enforcement process once a complaint is received. Have had two requests for seasonal summer tents. 3. Medical Marijuana is at a stalemate at this time. There is no assigned retail space. The Department of Public Health (DPH) will assign a group of individuals to sell medical marijuana on Nantucket. Noted that his office has nothing to do with licensing. 4. Finally received a list and sent out licensing forms to 109 waste haulers on Nantucket. Anything over 10 C &D trips to the dump in 12 months is considered licensable. 5. The DPH and DEP have taken Mr. Ray's recommendation about beach water testing, and the change will be in place by June 1. It allows, on select beaches, that a single elevated count won't close the beach; you need two elevated count in a 24 -hour period. 6.
