Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139- 33.A(3)(a) that the
proposed alteration and structural change to the pre - existing non - conforming structure does
not increase its non - conforming nature.
2. The Applicant proposes to temporarily lift and relocate a pre- existing nonconforming
structure for the purpose of conducting an archaeological dig on the premises. The Applicant
proposes to move the shed ten (10) feet to the south of its current location. Upon completion
of the archeological work, the shed will be placed back in its original location upon a new
pargetted concrete rock foundation with a maximum visibility of eight (8) inches, as
permitted in Nantucket Historic District Commission Certificate of Appropriateness No.
61441.
3. The historic structure, a 290 square foot wood shed known as the `Boston -
Higginbothom Hen House ", is pre- existing non - conforming as to rear and side yard setbacks
being sited as close as two (2) feet from the southerly rear yard lot line and as close as 3.4
feet from the easterly side yard lot line in the Residential Old Historic zoning district where
a minimum five (5) foot side and rear yard setback is required. The two structures on the lot,
a 903 SF single -story building known as "The African Meeting House ", and the above -
referenced shed, pre-exist the adoption of the zoning by -law. The locus, shown on the plan
entitled "Site Plan of Land in Nantucket, Mass. Prepared for Museum of Afro - American
History, Inc. ", prepared by Blackwell & Associates, Inc., dated June 12, 2013, a reduced
copy of which is attached herewith as "Exhibit A ", is pre- existing nonconforming with
respect to lot size, having an area of approximately 4,790 square feet in a zoning district with
a minimum lot size requirement of 5,000 square feet. Locus benefits from a Variance (Board
of Appeals Decision No. 101 -88) which granted relief to enable the conveyance of the
subject undersized lot out of common ownership with the adjoining parcel, 27 York Street,
shown as Lot 2 on "Exhibit A ". Lot 2 was subsequently conveyed to the Museum of Afro -
American History, Inc. in 2001 (per deed recorded with the Nantucket Registry of Deeds at
Book 711, Page 94), thus placing Lot 1 and Lot 2 in common ownership by the Applicant.
4. Therefore, because the proposed temporary relocation, as shown on the Plan attached
herewith as "Exhibit B ", will not result in an increase to the pre- existing non - conforming
side and rear yard setbacks, the Zoning Administrator finds that the proposed work will not
increase the pre- existing nonconforming nature of the Locus.
