The locus contains one single family dwelling, substantial portions of which date as far back as 1746. The dwelling is approximately 1,904 SF, which is well below the 50% ground cover allowed in the ROH zone. The dwelling is a close as 0.2 feet to the front lot line in a district has a 0 foot front yard setback, and 5 foot side and rear yard setbacks. The lot and the structures pre -date the adoption of zoning, and indeed pre -date the laying out of the public way, Judith Chase Lane (A /K /A Mooers Lane). The lot is dimensionally conforming and has no nonconforming uses. The Applicant proposes to subdivide the locus, and create two conforming lots though an Approval- Not - Required subdivision, which was endorsed by the Planning Board on August 12, 2013 (attached). However, with these boundaries, the western lot, which would contain the existing dwelling, would have a setback nonconformity if the dwelling is not relocated (the eastern lot would be vacant, except for an old covered well). The Applicant applied December 13, 2013 to the Nantucket Historic District Commission for permission to lift the house, move it the required distance to the west out of the new ANR setback, and to place it down on a new foundation sheathed to appear to be a ruble foundation. Numerous abutters opposed moving the historic dwelling and on February 4, 2014, the HDC voted to deny the request, asserting that the house should not be moved or altered, with Commissioners asserting that it was an old historic structure with a unique relationship to the road. The HDC filed this decision with the Town Clerk on February 18, 2014. The Applicant has appealed the HDC decision to the Board of Selectmen on the grounds that it is arbitrary and capricious, the hearing for which is pending. Further, the applicant notes that under the HOC Act, the HDC application appears to have been constructively approved due to the failure of the HDC to act within 60 days of the filing of the application. Nonetheless, the Applicant seeks variance relief from the Zoning Board of Appeals on two grounds, either of which would allow for an ANR subdivision to be zoning compliant without the need to pursue the HOC appeal or the constructive grant approval, thus allowing the historic dwelling to remain in its current location. First, the Applicant seeks relief by Variance from the requirement of Section 139- 16(Bx3) to allow so-called frontage averaging of the two new lots without meeting the requirement to provide a minimum frontage of 50 feet and the requirement that the width not be reduced at any depth within the yard less than 50 feet. Although the locus has about 137.11+/ - feet of frontage, where only 100 feet would be required to create two conforming lots, the location of the dwelling requires the eastern lot to have only 46.9 feet of frontage in order to avoid created a side -yard setback issue for dwelling on the new western lot, and the eastern lot would have be as narrow as 44.2 feet at its narrowest point. Second, in the alternative, Applicant seeks relief by Variance from the side yard setback of 5 feet from Section 139- 16(A), to the extent that proving the minimum 50 feet of frontage to the eastern lot would put the dwelling as at least as close as 2.2 feet to the new side yard lot line. Between these two variances, the variance to the frontage averaging is preferred because it would allow for the structure to be outside the future setbacks. If approved, the new lots would conform to the zoning bylaw in all other dimensional respects. If either variance is approved, the lots would be more conforming that most in the area, many of which are undersized, have setback encroachments, and lack sufficient frontage. Due to the shape of the locus and structure, a literal enforcement of the provisions of Chapter 139 would be a substantial hardship on the Applicant, but the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the bylaw. Therefore, the Applicant seeks relief by Variance under Section 139 -32 to waive the requirements of Section 139 -I6, as above. As abutters; we are concerned about the impact of the project on the existing historical environmental context of the area known as the "fish lots ". The house has been there since before the road was built It was situated facing south to face the sun as were many of the original houses that were moved from the original Sherburne settlement to Nantucket town. The house's position on the street defines the historic context of the area. To move the house back and away from its present location would erode the significance of the fact that the house was there before the street The present location is what separates the historic from the present day. This is Nantucket history in its purest form. Passersby immediately notice the eastern comer which juts out into the sidewalk. It may not be most convenient in present day but history must be preserved above the whims and wishes of modem development The preservation of the footprint of this house should be a major concem for the Commission if the appearance from the publicly traveled way and its impact on the historical context of the area is truly at issue here. My husband and I own the property at 4 Traders Lane. The eastern boundary of our property borders on Pine Street. It has always been a pleasure to look at the unusual angle of #7, compared to the Lane. It conjures up reveries of how things used to be in the fish lots over 250 years ago. It has been a privilege to live in our eighteenth century neighborhood. Keeping its unique character is of utmost importance. Once things change, it is forever. Moving #7 would be yet another loss of history to the pragmatic present. This is happening all too frequently in the Old Historic District.
