NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 Assessor's Map 54, Parcel 130.8 U 42088 16A Milestone Road Land Court Plan No. 10937 -10 -1 Monomoy Village Condominium Unit 1; "Siasconset" Village Residential (VR) Plan File 23 -1 DECISION: 1. The Nantucket Zoning Board of Appeals held a public hearing on April 10, 2014, in the Community Meeting Room at the Public Safety Facility at 4 Fairgrounds Road, Nantucket, Massachusetts, regarding the application of Andrew C. Tenney and Jennifer Tenney, 3 Hollingshead Court, Medford, New Jersey 08055, Board of Appeals File No. 026 -14. The Board made the following Decision: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -33.A to alter the existing 988 square foot structure by constructing a screened -in porch in the exact location of an existing deck. The locus is pre- existing non- conforming with respect to use and ground cover and as such requires special permit relief and to the extent necessary Variance relief pursuant to Section 139 -32. The total additional ground cover for this unit will be 270 square feet, bringing the dwelling's entire ground cover to 1,258 square feet. The existing total ground cover of the eight (8) cottages is approximately 7,381 square feet where 4,000 square feet of ground cover is allowed. The proposed addition is within the buildable portion of the Property and will increase the ground cover of the entire lot from approximately 18.5% to approximately 19.7% in a zoning district where a maximum 10% ground cover is allowed. The total lot area is 40,000 square feet in a district that requires a minimum lot area of 20,000 square feet. The Locus is situated at 16A Milestone Road, is shown on Nantucket Assessor's Map 54 Parcel 130.8, and as Lot 113A upon Land Court Plan 10937 -10 -1. The premises are known as "Siasconset ", Unit 1 of the Monomoy Village Condominium as shown on Plan File 23 -1. Evidence of owner's title is recorded at Certificate of Title No. U42088 on file at the Nantucket County District of the Land Court. The site is zoned Village Residential (VR). 3. Our Decision is based upon the application and accompanying materials and representations and testimony received at the public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There was no opposition, written or oral, to the application. There were letters of support from the owners of the seven other condominium units on the premises. 4. Michael Sweeney, who represented the applicant at the hearing, explained that the applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -33.A in order convert an existing 270 square foot deck into a screen porch. The applicant owns one of the eight condominium units in the Monomoy Village development off of Milestone Road. The applicant's condominium is in the southwesterly corner of the lot. The applicant represented that allowing this alteration to his structure will not have a significant and/or adverse impact on the integrity of the neighborhood. 5. The locus is pre - existing nonconforming with respect to the siting of eight structures on a single lot where a maximum of two are allowed pursuant to 139- 7.B(1). In Board of Appeals Decision No. 056 -86, the locus was granted Special Permit relief to extend and alter the pre- existing nonconforming use and structures, validating the year - round condominium ownership of the eight cottages for single - family residential use. Locus is also pre- existing nonconforming as to ground cover. As shown on plan, entitled "ZBA Exhibit Plan of Monomoy Village Condominium ", prepared by Paul J. Santos, PLS, dated April 8, 2014, a reduced copy of which is attached hereto and marked as "Exhibit A ", the total ground cover of the eight units on the lot is approximately 18.5% in a zoning district with a maximum allowance of 10 %. While this 270 square foot addition is built on the precise footprint of the existing deck, it results in an increase in the ground cover by 1.2 %, bringing the total ground cover to 19.7 %. Pursuant to bylaw Section 139- 33.A(4)(d), the alteration or extension of a pre- existing nonconforming structure or use which results in an excess of the permitted ground cover may be allowed by special permit provided that the alteration shall not be substantially more detrimental to the neighborhood. Furthermore, there are a set of steps off of the existing deck which encroach into the side yard setback, being sited as close as 9.7 feet from the westerly side yard lot line in a zoning district where a ten (10) foot side yard setback is required. Mr. Sweeney stated that these steps will be removed and relocated to the side to resolve this setback encroachment. 6. The Board finds that granting the requested Special Permit relief to allow the applicant to enclose an existing 270 square foot deck to the rear of the subject structure is in harmony with the purpose and intent of the Zoning Bylaw and will not be substantially more detrimental to the neighborhood than the existing nonconformities upon the Premises. 7. By a vote of FOUR in favor and ONE (Toole) opposed, the Board votes to grant the requested Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139 - 33.A to allow for the conversion of a deck into an enclosed porch on the rear elevation of the dwelling subject to the following conditions: a. The alteration shall be in substantial compliance with Certificate of Appropriateness No. 61064 granted by the Historic District Commission. b. The existing deck steps, currently sited 9.7 feet from the side -yard lot line, will be removed and relocated to the side of the porch to resolve the setback intrusion. c. The screen porch may not be converted into interior livable space without a modification to this decision.
